5360 - al-Mundhir ibn Shadhan narrated to us, 'Ubayd Allah ibn Musa narrated to us, Ibn Abi Layla informed us, from al-Minhal, from Zirr ibn Hubaysh, from 'Ali regarding: "And [do not approach prayer] in a state of janaba, except those passing through [a place of prayer]," he said: One does not approach prayer unless he is a traveler who is afflicted by janaba and finds no water; he performs tayammum and prays until he finds water. It was narrated from Ibn 'Abbas in one of the narrations, as well as Sa'id ibn Jubayr and al-Dahhak, similarly.

5361 - Muhammad ibn 'Ammar narrated to us, 'Abd al-Rahman al-Dashtaki narrated to us, Abu Ja'far al-Razi informed us, from Zayd ibn Aslam, from 'Ata' ibn Yasar, from Ibn 'Abbas regarding His saying: "And [do not approach prayer] in a state of janaba, except those passing through [a place of prayer]," he said: Passing through it transiently without sitting. It was narrated from 'Abd Allah ibn Mas'ud, Anas ibn Malik, Abu 'Ubaydah, Sa'id ibn al-Musayyib, Abu al-Duha, 'Ata', Mujahid, Masruq, Ibrahim al-Nakha'i, Zayd ibn Aslam, Abu Malik, 'Amr ibn Dinar, al-Hakam ibn 'Utaybah, 'Ikrimah, al-Hasan al-Basri, Yahya ibn Sa'id al-Ansari, Ibn Shihab, and Qatadah similarly.
His saying, the Exalted: "And if you are ill or on a journey"

5362 - al-Ashajj narrated to us, Shuja' ibn al-Walid narrated to us, from 'Ata' ibn al-Sa'ib, from Sa'id ibn Jubayr, from Ibn 'Abbas regarding His saying: "And if you are ill or on a journey," he said: It is a man who has been subjected to a prescribed punishment (hadd) or has a wound, and he fears that if he performs ghusl he will die, so he should perform tayammum on clean soil. It was narrated from 'Ikrimah, Mujahid, al-Hasan, al-Suddi, 'Ata' al-Khurasani, Ibrahim al-Nakha'i, al-Hakam, and Hammad similarly.
The second view:
5363 - al-Hasan ibn Abi al-Rabi' narrated to us, 'Abd al-Razzaq informed us, Ibn Jurayj informed us, who said: I mentioned to 'Ata' the case of the one who was punished with a hadd and his concession regarding not performing wudu', and I recited to him: "And if you are ill or on a journey," and he was silent, until I reached: "And you do not find water." He said: Enough! "And if you do not find water"—that is only when you find no water, "then perform clean ablution." I said: What if the one punished has a wet dream and ghusl is required of him? By Allah, I once had a wet dream—'Ata' is the speaker—while I was under a hadd punishment, and I performed ghusl. He said: It is for them all, if they do not find water.
٥٣٦٠ - حَدَّثَنَا الْمُنْذِرُ بْنُ شَاذَانَ، ثنا عُبَيْدُ اللَّهِ بْنُ مُوسَى، أَخْبَرَنَا ابْنُ أَبِي لَيْلَى، عَنِ الْمِنْهَالِ، عَنْ زِرِّ بْنِ حُبَيْشٍ، عَنْ عَلِيٍّ وَلا جُنُباً إِلا عَابِرِي سَبِيلٍ قَالَ: لَا يَقْرَبُ الصَّلاةَ إِلا أَنْ يَكُونَ مُسَافِراً تُصِيبُهُ الْجَنَابَةُ فَلا يَجِدُ مَاءً، يَتَيَمَّمُ وَيُصَلِّي حَتَّى يَجِدَ الْمَاءَ- وَرُوِيَ عَنِ ابْنِ عَبَّاسٍ فِي إِحْدَى الرِّوَايَاتِ وَسَعِيدِ بْنِ جُبَيْرٍ وَالضَّحَّاكِ نَحْوَ ذَلِكَ.

٥٣٦١ - حَدَّثَنَا مُحَمَّدُ بْنُ عَمَّارٍ، ثنا عَبْدُ الرَّحْمَنِ الدَّشْتَكِيُّ، أَنْبَأَ أَبُو جَعْفَرٍ الرَّازِيُّ، عَنْ زَيْدِ بْنِ أَسْلَمَ، عَنْ عَطَاءِ بْنِ يَسَارٍ، عَنِ ابْنِ عَبَّاسٍ فِي قَوْلِهِ: وَلا جُنُباً إِلا عَابِرِي سَبِيلٍ قَالَ: تَمُرُّ بِهِ مَرَّاً وَلا تَجْلِسُ- وَرُوِيَ عَنِ عَبْدِ اللَّهِ بْنِ مَسْعُودٍ وَأَنَسِ ابن مَالِكٍ، وَأَبِي عُبَيْدَةَ، وَسَعِيدِ بْنِ الْمُسَيِّبِ، وَأَبِي الضُّحَى وَعَطَاءٍ وَمُجَاهِدٍ وَمَسْرُوقٍ وَإِبْرَاهِيمَ النَّخَعِيِّ وَزَيْدِ بْنِ أَسْلَمَ وَأَبِي مَالِكٍ، وَعَمْرِو بْنِ دِينَارٍ، والحكم ابن عُتَيْبَةَ وَعِكْرِمَةَ وَالْحَسَنِ الْبَصْرِيِّ، وَيَحْيَى بْنِ سَعِيدٍ الأَنْصَارِيِّ وَابْنِ شِهَابٍ، وَقَتَادَةَ نَحْوُ ذَلِكَ.

٥٣٦٢ - حَدَّثَنَا الأَشَجُّ، ثنا شُجَاعُ بْنُ الْوَلِيدِ، عَنْ عَطَاءِ بْنِ السَّائِبِ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، عَنِ ابْنِ عَبَّاسٍ قَوْلَهُ: وَإِنْ كُنْتُمْ مَرْضَى أَوْ عَلَى سَفَرٍ قَالَ: هُوَ الرَّجُلُ الْمَحْدُودُ أَوْ بِهِ الْجَرْحُ، فَيَخَافُ أَنْ يَغْتَسِلَ فَيَمُوتَ فَلْيَتَيَمَّمِ الصَّعِيدَ- وَرُوِيَ عَنِ عِكْرِمَةَ وَمُجَاهِدٍ وَالْحَسَنِ وَالسُّدِّيِّ وَعَطَاءٍ الْخُرَاسَانِيِّ وَإِبْرَاهِيمَ النَّخَعِيِّ وَالْحَكَمِ، وَحَمَّادٍ نَحْوَ ذَلِكَ.
وَالْوَجْهُ الثَّانِي:
٥٣٦٣ - حَدَّثَنَا الْحَسَنُ بْنُ أَبِي الرَّبِيعِ، أَنْبَأَ عَبْدُ الرَّزَّاقِ، أَنْبَأَ ابْنُ جُرَيْجٍ قَالَ: ذَكَرْتُ لِعَطَاءٍ شَأْنَ الْمَحْدُودِ وَرُخْصَتَهُ فِي أَلا يَتَوَضَّأَ، وَتَلَوْتَ عَلَيْهِ: وَإِنْ كُنْتُمْ مَرْضَى أَوْ عَلَى سَفَرٍ وَهُوَ سَاكِتٌ، فَكَذَلِكَ حَتَّى جِئْتُ: فَلَمْ تَجِدُوا مَاءً قَالَ: حَسْبُكَ فَإِنْ لَمْ تَجِدُوا مَاءً فَإِنَّمَا ذَلِكَ إِذَا لَمْ تَجِدُوا مَاءً فَلْيَتَطَهَّرُوا، قُلْتُ: وَإِنْ احْتَلَمَ الْمَحْذُورُ عَلَيْهِ الْغُسْلَ، وَاللَّهِ لَقَدِ احْتَلَمْتُ مَرَّةً- عَطَاءٌ الْقَائِلُ- وَأَنَا مَحْدُودٌ، فَاغْتَسَلْتُ قَالَ: هِيَ لَهُمْ كُلُّهُمْ إِذَا لَمْ يَجِدُوا مَاءً.
