[5791] Abu Zur'ah narrated to us, Yahya ibn 'Abd Allah ibn Bukayr narrated to us, 'Abd Allah ibn Lahi'ah narrated to me, 'Ata' ibn Dinar narrated to me, from Sa'id ibn Jubayr: "And blood money delivered to his family," meaning: The killer's 'aqilah (agnate kin) shall deliver it.
His saying, the Exalted: "To his family."
[5792] And by this [chain], from Sa'id ibn Jubayr, regarding the saying of Allah the Exalted: "To his family," [meaning] to the heirs of the slain person. It was narrated from Ibrahim al-Nakha'i, Qatadah, and Muqatil ibn Hayyan that they said: To the heirs of the slain person.
His saying, the Exalted: "Unless they give [it as] charity."
[5793] My father narrated to us, Abu Salih narrated to us, Mu'awiyah ibn Salih narrated to me, from 'Ali ibn Abi Talhah, from Ibn 'Abbas, meaning His saying: "Unless they give [it as] charity," meaning: Unless they give it as charity to him [the killer].
[5794] Abu Zur'ah narrated to us, Yahya ibn 'Abd Allah ibn Bukayr narrated to us, Ibn Lahi'ah narrated to me, 'Ata' narrated to me, from Sa'id ibn Jubayr who said: He then made an exception, then he said: "Unless they give [it as] charity," meaning: Unless the heirs of the slain person give the blood money as charity to the killer, for that is better for them. As for the freeing of a slave, it is obligatory upon the killer from his own wealth.
[5795] Ahmad ibn 'Uthman ibn Hakim al-Awdi narrated to us, Ahmad ibn Mufaddal narrated to us, Asbat narrated to us, from al-Suddi, regarding His saying: "Unless they give [it as] charity," [meaning] they waive the blood money. It was narrated from Ibrahim al-Nakha'i something similar.
His saying, the Exalted: "But if it is."

[5796] Abu Zur'ah narrated to us, Yahya ibn 'Abd Allah ibn Bukayr narrated to us, 'Abd Allah ibn Lahi'ah narrated to me, 'Ata' ibn Dinar narrated to me, from Sa'id ibn Jubayr, regarding His saying: "But if it is," meaning: the slain person, "from a people hostile to you."
[5797] Ahmad ibn Mansur al-Ramadi narrated to us, Abu al-Jawwab al-Ahwas ibn Jawwab narrated to us, 'Ammar ibn Zurayq narrated to us, from 'Ata' ibn al-Sa'ib, from Abu Yahya, from Ibn 'Abbas, regarding this verse: "But if it is from a people hostile to you and he is a believer," he said: "A man would come to the Prophet, may Allah bless him and grant him peace, then return to his people and remain with them while they were polytheists. Then, the Muslims would strike him by mistake during a military expedition or a raid, so the one who struck him would free a slave."

وَبِهِ عَنْ سَعِيدِ بْنِ جُبَيْرٍ فِي قَوْلِ اللَّهِ تَعَالَى: إِلَى أَهْلِهِ إِلَى أَوْلِيَاءِ الْمَقْتُولِ.
وَرُوِيَ عَنِ إِبْرَاهِيمَ النَّخَعِيِّ، وَقَتَادَةَ، وَمُقَاتِلِ بْنِ حَيَّانَ أَنَّهُمْ قَالُوا: إِلَى وَرَثَةِ الْمَقْتُولِ.
قَوْلُهُ تَعَالَى: إِلا أَنْ يَصَّدَّقُوا

حَدَّثَنَا أَبِي، ثنا أَبُو صَالِحٍ، حَدَّثَنِي مُعَاوِيَةُ بْنُ صَالِحٍ، عَنْ عَلِيِّ بْنِ أَبِي طَلْحَةَ، عَنِ ابْنِ عَبَّاسِ يَعْنِي قَوْلَهُ: إِلا أَنْ يَصَّدَّقُوا: إِلا أَنْ يَتَصَدَّقَ بِهَا عَلَيْهِ.
٥٧٩٤ - حَدَّثَنَا أَبُو زُرْعَةَ، ثنا يَحْيَى بْنُ عَبْدِ اللَّهِ بْنِ بُكَيْرٍ، حَدَّثَنِي ابْنُ لَهِيعَةَ، حَدَّثَنِي عَطَاءٌ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ قَالَ: ثُمَّ اسْتَثْنَى، ثُمَّ قَالَ: إِلا أَنْ يَصَدَّقُوا يَعْني إِلا أَنْ يَصَّدَّقَ أَوْلِيَاءُ الْمَقْتُولِ بِالدِّيَةِ عَلَى الْقَاتِلِ فَهُوَ خَيْرٌ لَهُمْ، فَأَمَّا عِتْقُ رَقَبَةٍ فَإِنَّهُ وَاجِبٌ عَلَى الْقَاتِلِ مِنْ مَالِهِ.
٥٧٩٥ - حَدَّثَنَا أَحْمَدُ بْنُ عُثْمَانَ بْنِ حَكِيمٍ الأَوْدِيُّ، ثنا أَحْمَدُ بْنُ مُفَضَّلٍ، ثنا أَسْبَاطٌ، عَنِ السُّدِّيِّ قَوْلُهُ: إِلا أَنْ يَصَّدَّقُوا فَيَتْرُكُوا الدِّيَةَ. وَرُوِيَ عَنِ إِبْرَاهِيمَ النَّخَعِيِّ نَحْوُ ذلك.

٥٧٩٧ - أَحْمَدُ بْنُ مَنْصُورٍ الرَّمَادِيُّ، ثنا أَبُو الْجَوَّابِ الأَحْوَصُ بْنُ جَوَّابٍ، ثنا عمار ابن زريق، عَنْ عَطَاءِ بْنِ السَّائِبِ، عَنْ أَبِي يَحْيَى، عَنِ ابْنِ عَبَّاسٍ فِي هَذِهِ الآيَةِ فَإِنْ كَانَ مِنْ قَوْمٍ عَدُوٍّ لَكُمْ وَهُوَ مُؤْمِنٌ قَالَ: كَانَ الرَّجُلُ يَأْتِي النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ثُمَّ يَرْجِعُ إِلَى قَوْمِهِ فَيَكُونَ مَعَهُمْ وَهُمْ مُشْرِكُونَ فَيُصِيبُهُ الْمُسْلِمُونَ خَطَاً فِي سَرِيَّةٍ أَوْ غَارَةٍ فَيُعْتِقُ الَّذِي يُصِيبُهُ رَقَبَةً.
