5809 - My father narrated to us, Musa ibn Isma'il narrated to us, Mubarak narrated to us, al-Hasan [said] regarding His saying: "then [the fast of] two consecutive months," as a rigorous penalty and a severity from Allah. He said: This [decree] regarding [killing by] mistake is a severity from Allah.
His saying, the Exalted: "consecutive."
[5810] My father narrated to us, Abu Hudhayfah narrated to us, Shibl narrated to us, from Ibn Abi Najih, from Mujahid, and I asked him about the fasting of two consecutive months. He said: He should not break the fast during them, nor should he interrupt his fasting. If he does so without [reason of] sickness or excuse, he must restart the entire fast. If a sickness or excuse befalls him, he may [continue to] fast the remainder of them. If he dies before completing the fast, sixty poor people should be fed on his behalf, with one mudd for every poor person.
His saying, the Exalted: "[as] a repentance from Allah."
[5811] Abu Zur'ah narrated to us, Yahya ibn 'Abd Allah ibn Bukayr narrated to us, 'Abd Allah ibn Lahi'ah narrated to me, 'Ata' ibn Dinar narrated to me, from Sa'id ibn Jubayr regarding His saying: "[as] a repentance from Allah," meaning: a pardon from Allah for this community when He established for killing by mistake a kaffarah (expiatory atonement) and blood money.
His saying, the Exalted: "And Allah is ever Knowing, Wise."
[5812] And by the same chain from Sa'id ibn Jubayr concerning the saying of Allah, the Exalted: "And Allah is ever Knowing, Wise," meaning: the ruling of the kaffarah for one who killed by mistake, and then it [the blood money] for the covenant and peace treaty [made] with the polytheists of the Arabs became abrogated. The verse which is in [Surat] Bara'ah abrogated it: "And kill the polytheists wherever you find them."
And the Prophet, peace and blessings of Allah be upon him, said: "People of two different religions do not inherit from one another."
His saying, the Exalted: "And whoever kills a believer intentionally."

5813 - Muhammad ibn 'Abd Allah ibn Yazid al-Muqri' narrated to us, Sufyan narrated to us, from 'Ammar (meaning al-Duhni), from Salim ibn Abi al-Ja'd, who said: Ibn 'Abbas was asked about a man who killed a person intentionally, then repented, acted righteously, and then remained guided. He said: Woe to you, and how can he have guidance? I heard your Prophet, peace and blessings of Allah be upon him, saying: "The victim will come on the Day of Resurrection, clinging to the killer, and saying: 'Ask this one, why did he kill me?'" By Allah, Allah sent it down upon His Prophet, and then He did not abrogate it.

٥٨٠٩ - حَدَّثَنَا أَبِي، ثنا مُوسَى بْنُ إِسْمَاعِيلَ، ثنا مُبَارَكٌ، ثنا الْحَسَنُ قَوْلَهُ: فَمَنْ لَمْ يَجِدْ فَصِيَامُ شَهْرَيْنِ مُتَتَابِعَيْنِ تَغْلِيظاً وَتَشْدِيداً مِنَ اللَّهِ قَالَ: هَذَا فِي الْخَطَأِ تَشْدِيدٌ مِنَ اللَّهِ.

حَدَّثَنَا أَبِي، ثنا أَبُو حُذَيْفَةَ، ثنا شِبْلٌ، عَنِ ابْنِ أَبِي نَجِيحٍ، عَنْ مُجَاهِدٍ، وَسَأَلْتُهُ عَنْ صِيَامِ شَهْرَيْنِ مُتَتَابِعَيْنِ قَالَ: لَا يَفْطُرُ فِيهَا وَلا يَقْطَعُ صِيَامَهَا فَإِنْ فَعَلَ مِنْ غَيْرِ مَرَضٍ وَلا عُذْرٍ اسْتَقْبَلَ صِيَامَهَا جَمِيعاً، فَإِنْ عَرَضَ لَهُ مَرَضٌ أَوْ عُذْرٌ صَامَ مَا بَقِيَ مِنْهُمَا فَإِنْ مَاتَ وَلَمْ يَصُمْ أُطْعِمَ عَنْهُ سِتُّونَ مِسْكِيناً لِكُلِّ مِسْكِينٍ مُدٌّ.
قَوْلُهُ تَعَالَى: تَوْبَةً مِنَ اللَّهِ

حَدَّثَنَا أَبُو زُرْعَةَ، ثنا يَحْيَى بْنُ عَبْدِ اللَّهِ بْنِ بُكَيْرٍ، حَدَّثَنِي عَبْدُ اللَّهِ بْنُ لَهِيعَةَ، حَدَّثَنِي عَطَاءُ بْنُ دِينَارٍ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ قَوْلَهُ: تَوْبَةً مِنَ اللَّهِ يَعْنِي تَجَاوُزاً مِنَ اللَّهِ لِهَذِهِ الأُمَّةِ حِينَ جَعَلَ فِي قَتْلِ الْخَطَأِ كَفَّارَةً وَدِيَةً.
قَوْلُهُ تَعَالَى: وَكَانَ اللَّهُ عَلِيماً حَكِيماً

وَبِهِ عَنْ سَعِيدِ بْنِ جُبَيْرٍ فِي قَوْلِ اللَّهِ تَعَالَى: وَكَانَ اللَّهُ عَلِيماً حَكِيماً يَعْنِي حُكْمَ الْكَفَّارَةِ لِمَنْ قَتَلَ خَطَاً ثُمَّ صَارَتْ دِيَةً فِي الْعَهْدِ وَالْمُوَادَعَةِ لِمُشْرِكِي الْعَرَبِ مَنْسُوخَةً، نَسَخَتْهَا الآيَةُ الَّتِي فِي بَرَاءَةٍ فَاقْتُلُوا الْمُشْرِكِينَ حَيْثُ وَجَدْتُمُوهُمْ
وَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: لَا يَتَوَارَثُ أَهْلُ مِلَّتَيْنِ.
قَوْلُهُ تَعَالَى: وَمَنْ يَقْتُلْ مؤمنا متعمدا

٥٨١٣ - حَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ يَزِيدَ الْمُقْرِئُ، ثنا سُفْيَانُ، عَنْ عَمَّارٍ يَعْنِي الدُّهْنِيَّ، عَنْ سَالِمِ بْنِ أَبِي الْجَعْدِ قَالَ: سُئِلَ ابْنُ عَبَّاسٍ عَنْ رَجُلٍ قَتَلَ قَتِيلا مُتَعَمِّداً، ثُمَّ تَابَ وَعَمِلَ صَالِحاً، ثُمَّ اهْتَدَى. قَالَ: وَيْحَكَ وَأَنَّى لَهُ الْهُدَى، سَمِعْتُ نَبِيَّكُمْ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَقُولُ: يَجِيءُ الْمَقْتُولُ يَوْمَ الْقِيَامَةِ مُتَعَلِّقاً بِالْقَاتِلِ فَيَقُولُ: سَلْ هَذَا لِمَ قَتَلَنِي؟ وَاللَّهِ لَقَدْ أَنْزَلَهَا اللَّهُ عَلَى نَبِيِّهِ ثم ما نسخها «١» .
