[The Seventh Aspect]
[6710] ‘Ali ibn al-Hasan al-Hisinjani narrated to us, Musaddad narrated to us, Khalid ibn ‘Abd Allah al-Wasiti narrated to us, ‘Ata’ ibn al-Sa’ib narrated to us from Tawus, from Ibn ‘Abbas, who said: The unintentional oath (laghw al-yamin) is that you swear while you are angry.
His saying, the Almighty: "But He will impose blame upon you..."
[6711] ‘Ali ibn al-Hasan narrated to us, Musaddad narrated to us, Abu ‘Awanah narrated to us, from Abu Bishr, from Sa‘id ibn Jubayr, regarding His saying: "Allah will not impose blame upon you for what is unintentional in your oaths." I said: It is a man saying, "No, by Allah" and "Yes, by Allah." He said: No, rather it is your prohibiting what Allah has made lawful for you; for that is what Allah will not hold you accountable for abandoning, so offer an expiation for your oath.
His saying, the Almighty: "...for what you have intended of oaths."
[6712] Abu Sa‘id al-Ashajj narrated to us: Waki‘ narrated to us, from Sufyan, from Abu Najih, from Mujahid, regarding "But He will impose blame upon you for what you have intended of oaths," he said: What you have intentionally done. And it has been narrated from ‘Ata’ something similar.
[6713] And al-‘Abbas ibn al-Walid narrated to us, Ibn Shu‘ayb—meaning Muhammad ibn Shu‘ayb ibn Shapur—informed me, ‘Uthman ibn ‘Ata’ informed me, from his father, from ‘Ata’ ibn Abi Muslim, that he said: As for "what you have intended of oaths," it is said: What you have resolved to fulfill. Abu Muhammad said: Meaning, that you do not break the oath.
His saying, the Almighty: "...the expiation for it..."
[6714] Abu Zur‘ah narrated to us, Yahya ibn ‘Abd Allah ibn Bukayr narrated to us, ‘Abd Allah ibn Lahia’ narrated to me, ‘Ata’ ibn Dinar narrated to me, from Sa‘id ibn Jubayr, regarding His saying: "the expiation for it," meaning: for the intentional, lying oath, is the feeding of ten needy persons.
His saying, the Almighty: "...feeding of ten needy persons."
[The First Aspect]
[6715] Muhammad ibn Isma‘il al-Ahmasi narrated to us, Waki‘ narrated to us, from Ibn Abi Layla, from ‘Amr ibn Murrah, from ‘Abd Allah ibn Salamah, from ‘Ali, who said: Regarding the expiation of an oath: It is the feeding of ten needy persons, for every needy person one sa‘ of wheat. And it has been narrated from ‘Amr, ‘A’ishah, Mansur ibn ‘Imran, Mujahid, Ibrahim al-Nakha‘i, al-Sha‘bi, Sa‘id ibn Jubayr, al-Hakam, Abu Malik, al-Dahhak, Muqatil ibn Hayyan, Makhul, and Abu Qilabah something similar to that.
وَالْوَجْهُ السَّابِعُ:
٦٧١٠ - حَدَّثَنَا عَلِيُّ بْنُ الْحَسَنِ الْهِسِنْجَانِيُّ ثنا مُسَدَّدٌ ثنا خَالِدُ بْنُ عَبْدِ اللَّهِ الْوَاسِطِيُّ ثنا عطا بن الشايب عَنْ طَاوُسٍ عَنِ ابْنِ عَبَّاسٍ قَالَ: لَغْوُ الْيَمِينِ أَنْ تَحْلِفَ وَأَنْتَ غَضْبَانٌ.
قَوْلُهُ تَعَالَى: وَلَكِنْ يُؤَاخِذُكُمْ
٦٧١١ - حَدَّثَنَا عَلِيُّ بْنُ الْحَسَنِ، حَدَّثَنَا مُسَدَّدٌ، ثنا أَبُو عَوَانَةَ عَنْ أَبِي بِشْرٍ عَنِ سَعِيدِ بْنِ جُبَيْرٍ فِي قَوْلِهِ: لَا يُؤَاخِذُكُمُ اللَّهُ بِاللَّغْوِ فِي أَيْمَانِكُمْ قُلْتُ: هُوَ قَوْلُ الرَّجُلِ لَا وَاللَّهِ وَبَلَى وَاللَّهِ، قَالَ: لَا وَلَكِنَّهُ تَحْرِيمُكَ مَا أَحَلَّ اللَّهُ لَكَ فَذَلِكَ الَّذِي لَا يُؤَاخِذُكَ اللَّهُ بِتَرْكِهِ، وَكَفِّرْ عَنْ يَمِينِكِ.
قَوْلُهُ تَعَالَى: بِمَا عَقَّدْتُمُ الأَيْمَانَ
٦٧١٢ - حَدَّثَنَا أَبُو سَعِيدٍ الأَشَجُّ: ثنا وَكِيعٌ عَنْ سفيان عن أَبِي نَجِيحٍ عَنْ مُجَاهِدٍ وَلَكِنْ يُؤَاخِذُكُمْ بِمَا عَقَّدْتُمُ الأَيْمَانَ قَالَ: مَا تَعَمَّدْتُمْ- وَرُوِيَ عَنْ عَطَاءٍ نَحْوُ ذَلِكَ.
٦٧١٣ - وَحَدَّثَنَا الْعَبَّاسُ بْنُ الْوَلِيدِ، أَخْبَرَنِي ابْنُ شُعَيْبٍ يَعْنِي مُحَمَّدَ بْنَ شُعَيْبِ بْنِ شَابُورَ، أَخْبَرَنِي عُثْمَانُ بْنُ عَطَاءٍ عَنْ أَبِيهِ عَنِ عَطَاءِ بْنِ أَبِي مُسْلِمٍ أَنَّهُ قَالَ: أَمَّا مَا عَقَّدْتُمُ الأَيْمَانَ، فَيُقَالُ: مَا عَزَمْتُمْ عَلَى وفائه- قال أبو محمد يعني: أن لا تَحْنِثُوا
قَوْلُهُ تَعَالَى: فَكَفَّارَتُهُ
٦٧١٤ - حَدَّثَنَا أَبُو زُرْعَةَ، ثنا يَحْيَى بْنُ عَبْدِ اللَّهِ بْنِ بُكَيْرٍ، حَدَّثَنِي عَبْدُ اللَّهِ بْنُ لَهِيعَةَ حَدَّثَنِي عَطَاءُ بْنُ دِينَارٍ عَنْ سَعِيدِ بْنُ جُبَيْرٍ قوله: فكفارته يَعْنِي الْيَمِينَ الْعَمْدَ الْكَذِبَ. إِطْعَامُ عَشَرَةِ مَسَاكِينَ.

٦٧١٥ - حَدَّثَنَا مُحَمَّدُ بْنُ إِسْمَاعِيلَ الأَحْمَسِيُّ، ثنا وَكِيعٌ عَنِ ابْنِ أَبِي لَيْلَى عَنْ عَمْرِو بْنِ مُرَّةَ عَنْ عَبْدِ اللَّهِ بْنِ سَلَمَةَ عَنْ عَلِيٍّ قَالَ: فِي كَفَّارَةِ الْيَمِينِ: إِطْعَامُ عَشَرَةِ مَسَاكِينَ لِكُلِّ مِسْكِينٍ صَاعً مِنْ حِنْطَةٍ- وَرُوِيَ عَنْ عَمْرٍو وَعَائِشَةَ وَمَنْصُورِ بْنِ عِمْرَانَ وَمُجَاهِدٍ وَإِبْرَاهِيمَ النَّخَعِيِّ وَالشَّعْبِيِّ وَسَعِيدِ بْنِ جُبَيْرٍ وَالْحَكَمِ وَأَبِي مَالِكٍ وَالضَّحَّاكِ وَمُقَاتِلِ بْنِ حَيَّانَ وَمَكْحُولٍ وَأَبِي قِلابَةَ نَحْوُ ذَلِكَ.
