Abu Bakr said to Ubayy ibn Ka‘b, while he was sitting with him: "What is your view regarding it?" The Bedouin said: "I came to you while you are the Caliph of the Messenger of Allah, peace and blessings of Allah be upon him, seeking an answer from you, and yet you are asking someone else!" Abu Bakr said: "Do you not recall the saying of Allah: '...a penalty equal to what he has killed from the game, as adjudged by two just men among you'? I was consulting my companion until we agreed upon a matter, and then we would instruct you accordingly."
[6806] I read to Muhammad ibn al-Fadl, Muhammad ibn ‘Ali narrated to us, Muhammad ibn Muzahim Abu Wahb narrated to us, from Bukayr ibn Ma‘ruf, from Muqatil ibn Hayyan, regarding His saying: "[as] two just men among you have adjudged," he said: Two just men shall judge it in the case of one who kills game. It was reported from Abu al-Zinad similarly.
His saying: "[as] an offering"
[6807] My father narrated to us, Abu al-Nadr Ishaq ibn Ibrahim al-Faradisi al-Umawi narrated to us, Sa‘id ibn Yahya narrated to us, Muhammad ibn Ishaq narrated to us from Abu Ja‘far Muhammad ibn ‘Ali: That a man asked ‘Ali about the offering, what it consists of. He said: "[It consists of] the eight pairs." The man seemed to be in doubt. ‘Ali said: "Do you read the Quran?" He said: "Yes." He said: "Did you hear Allah say: 'O you who believe! Fulfill [your] obligations. Lawful to you [for food] are all the beasts of cattle'?" He said: "And I heard Him say: '...that they may mention the name of Allah over what He has provided them of the beasts of cattle.' And: 'And of the cattle, [some] for burden and [some] for slaughter.'" He said: "And did you hear Him say: 'Of the sheep two, and of the goats two, and of the camels two, and of the oxen two'?" He said: "And did you hear Allah say: 'O you who believe! Do not kill game while you are in the state of ihram,' up to His saying: 'as an offering reaching the Ka‘bah'?" The man said: "Yes." ‘Ali said: "I killed an antelope, what is upon me?" He said: "A sheep." ‘Ali said: "As an offering reaching the Ka‘bah?" The man said: "Yes." ‘Ali said: "Allah has indeed named it an offering reaching the Ka‘bah, as you hear."
[6808] My father narrated to us, Muqatil ibn Muhammad narrated to us, Waki‘ narrated to us, from Hanzalah, from al-Qasim ibn Muhammad, from Ibn ‘Umar, he said: The offering is only the superior animals.
[6809] I read to Muhammad ibn al-Fadl, Muhammad ibn ‘Ali narrated to us, Muhammad ibn Muzahim narrated to us, from Bukayr ibn Ma‘ruf, from Muqatil ibn Hayyan, regarding His saying: "as an offering reaching the Ka‘bah," he said: By "offering," he means: the camels [for sacrifice].
