Translation · EN

His saying, the Exalted: "And We ordained for them therein..."

[6436] My father narrated to us, Abu al-Walid 'Abd al-Malik ibn al-Asbagh ibn Muhammad ibn Marzuq narrated to us, al-Walid narrated to us, Abu 'Amr al-Awza'i narrated to us, al-Nadr ibn 'Amr al-Muqri' narrated to me, from al-Hasan, and I asked him about the saying of Allah: "And We ordained for them therein that a life is for a life" up to the completion of the verse; is it specifically for them? He said: It is for them, and for the people in general.

His saying, the Exalted: "...therein..."

[6437] My father narrated to us, Abu Hudhayfah narrated to us, Shibl narrated to us, from Ibn Abi Najih, from Mujahid, regarding His saying: "And We ordained for them therein"—Mujahid says: Ibn 'Abbas says: The Children of Israel were prescribed the law of retaliation (qisas) for those killed; there was no blood money (diyah) between them for either a life or a wound. That is the saying of Allah the Exalted: "And We ordained for them therein"—meaning in the Torah. Then Allah lightened [the ruling] for the nation of Muhammad, may Allah bless him and grant him peace, and He made the blood money (diyah) binding upon them for a life.

It was narrated from Muqatil ibn Hayyan that he said: We ordained for them in the Torah.

His saying: "...that a life is for a life..."

[6438] My father narrated to us, Abu Salih narrated to us, Mu'awiyah ibn Salih narrated to me, from 'Ali ibn Abi Talhah, from Ibn 'Abbas, regarding His saying: "a life is for a life"—he said: A life is killed for a life.

[6439] Abu Zur'ah narrated to us, Yahya ibn 'Abd Allah narrated to us, Ibn Lahi'ah narrated to me, 'Ata' ibn Dinar narrated to me, from Sa'id ibn Jubayr, regarding His saying: "a life is for a life"—he said: Meaning the life of a free Muslim for the life of a free Muslim, and for the free Muslim woman, when it is intentional. The Prophet, may Allah bless him and grant him peace, said: "A believer shall not be killed for a disbeliever."

His saying, the Exalted: "...and the eye for the eye..."

[6440] My father narrated to us, Abu Salih narrated to us, Mu'awiyah ibn Salih narrated to me, from 'Ali ibn Abi Talhah, from Ibn 'Abbas, he said: And the eye is gouged out for the eye—meaning His saying: "and the eye for the eye."

[6441] My father narrated to us, Abu Salih narrated to us, al-Layth narrated to me, 'Uqayl and Yunus narrated to me—and the narration belongs to 'Uqayl—he said: I asked Ibn Shihab about a man with one eye who gouged out the eye of a person with two healthy eyes; should his remaining eye be gouged out so that he becomes blind? He said: Allah's decree in His Book is that the eye is for the eye, so his eye [is forfeit], even if it were his only remaining sight.

قَوْلُهُ تَعَالَى: وَكَتَبْنَا عَلَيْهِمْ

٦٤٣٦ - حَدَّثَنَا أَبِي ثنا أَبُو الْوَلِيدِ عَبْدُ الْمَلِكِ بْنُ الأَصْبَغِ بْنِ مُحَمَّدِ بْنِ مَرْزُوقٍ، ثنا الْوَلِيدُ ثنا أَبُو عَمْرٍو الْأَوْزَاعِيُّ، حَدَّثَنِي النَّضْرُ بن عمرو المقري عَنِ الْحَسَنِ وَسَأَلْتُهُ عَنْ قَوْلِ اللَّهِ وَكَتَبْنَا عَلَيْهِمْ فِيهَا أَنَّ النَّفْسَ بِالنَّفْسِ إِلَى تَمَامِ الآيَةِ فَهِيَ عَلَيْهِمْ خَاصَّةً قَالَ:

عَلَيْهِمْ وَالنَّاسِ عَامَّةً.

قَوْلُهُ تَعَالَى: فِيهَا

٦٤٣٧ - حَدَّثَنَا أَبِي، ثنا أَبُو حُذَيْفَةَ ثنا شِبْلٌ عَنِ بَن أَبِي نَجِيحٍ، عَنْ مُجَاهِدٍ قَوْلَهُ:

وَكَتَبْنَا عَلَيْهِمْ فِيهَا قَالَ: مُجَاهِدٌ يَقُولُ ابْنُ عَبَّاسٍ: إِنَّ عَلَى بَنِي إِسْرَائِيلَ الْقِصَاصَ فِي الْقَتْلَى، لَيْسَ بَيْنَهُمْ دِيَةٌ فِي نَفْسٍ وَلا جُرْحٍ، وَذَلِكَ قَوْلُ اللَّهِ تَعَالَى وَكَتَبْنَا عَلَيْهِمْ فِيهَا فِي التوراة فخفف الله عن أُمَّةِ مُحَمَّدٍ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَجَعَلَ عَلَيْهِمُ الدِّيَةَ فِي النَّفْسِ.

وَرُوِيَ عَنْ مُقَاتِلِ بْنِ حَيَّانَ قَالَ: كَتَبْنَا عَلَيْهِمْ فِي التَّوْرَاةِ

قَوْلُهُ: أَنَّ النَّفْسَ بِالنَّفْسِ

٦٤٣٨ - حَدَّثَنَا أَبِي ثنا أَبُو صَالِحٍ حَدَّثَنِي مُعَاوِيَةُ بْنُ صَالِحٍ عَنْ عَلِيِّ بْنِ أَبِي طَلْحَةَ عن ابن عباس قَوْلَهُ: النَّفْسَ بِالنَّفْسِ قَالَ: تُقْتَلُ النَّفْسُ بِالنَّفْسِ.

٦٤٣٩ - حَدَّثَنَا أَبُو زُرْعَةَ ثنا يَحْيَى بْنُ عَبْدِ اللَّهِ حَدَّثَنِي ابْنُ لَهِيعَةَ، حَدَّثَنِي عَطَاءُ بْنُ دِينَارٍ عَنْ سَعِيدِ بْنِ جُبَيْرٍ قَوْلَهُ: النَّفْسَ بالنفس قال: يَعْنِي نَفْسَ الْمُسْلِمِ الْحُرِّ بِنَفْسِ الْمُسْلِمِ الْحُرِّ وَبَالْمُسْلِمَةِ إِذَا كَانَ عَمْدًا وَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: لَا يُقْتَلْ مُؤْمِنٌ بِكَافِر «١»

قَوْلُهُ تَعَالَى: وَالْعَيْنَ بِالْعَيْنِ

٦٤٤٠ - حَدَّثَنَا أَبِي، ثنا أَبُو صَالِحٍ حَدَّثَنِي مُعَاوِيَةُ بْنُ صَالِحٍ عَنْ عَلِيِّ بْنِ أَبِي طَلْحَةَ عَنِ ابْنِ عَبَّاسٍ قَالَ: وَتُفْقَأُ الْعَيْنُ بِالْعَيْنِ. يَعْنِي قَوْلَهُ: وَالْعَيْنَ بالعين
