Translation · EN

to 'Uqayl—he said: I asked Ibn Shihab about a man with one eye who gouged out the eye of a person with two healthy eyes; should his remaining eye be gouged out so that he becomes blind? He said: Allah's decree in His Book is that the eye is for the eye, so his eye [is forfeit], even if it were his only remaining sight.

His saying, the Exalted: "...and the nose for the nose..."

[6442] My father narrated to us, Abu Salih narrated to us, Mu'awiyah ibn Salih narrated to me, from 'Ali ibn Abi Talhah, from Ibn 'Abbas, regarding His saying: "and the nose for the nose"—he said: The nose is cut off for the nose.

His saying, the Exalted: "...and the ear for the ear..."

[6443] It was read to Muhammad ibn 'Abd Allah ibn 'Abd al-Hakam, 'Abd Allah ibn Wahb narrated to us, Yunus ibn Yazid informed me, from Rabi'ah, that he said regarding a man whom a group of people attacked and cut off both his ears: I am of the view that it should be done to them similar to what they did to him.

His saying, the Exalted: "...the tooth for the tooth..."

[6444] Abu Sa'id al-Ashajj narrated to us, Abu Khalid al-Ahmar narrated to us, from Humayd, from Anas, he said: The Messenger of Allah, may Allah bless him and grant him peace, ordered the implementation of retaliation (qisas) for the tooth, and he said: "The Book of Allah is retaliation."

His saying, the Exalted: "...and for wounds is legal retribution."

[6445] My father narrated to us, Abu Salih narrated to us, Mu'awiyah ibn Salih narrated to me, from 'Ali ibn Abi Talhah, from Ibn 'Abbas, regarding His saying: "and for wounds is legal retribution"—he said: Wounds are retaliated with wounds. This applies equally among free Muslims, both men and women, in cases of intentional harm to life or less than life. It also applies equally among slaves, both men and women, in cases of intentional harm to life or less than life.

[6446] Abu Yazid al-Qaratisi narrated to us, in what Asbagh ibn al-Faraj wrote to me: I heard 'Abd al-Rahman ibn Zayd ibn Aslam say, regarding His saying: "and for wounds is legal retribution"—meaning some for others.

His saying, the Exalted: "But whoever gives [his right as] charity..."

[6447] My father narrated to us, Abu Salih the scribe of al-Layth narrated to us, Mu'awiyah ibn Salih narrated to me, from 'Ali ibn Abi Talhah, from Ibn 'Abbas, regarding His saying: "But whoever gives [his right as] charity"—he says: Whoever pardons [the offender] and gives it as charity, then it is an expiation for the one sought [the offender] and a reward for the one seeking [the victim].
