[The second view]
[6478] Hajjaj ibn Hamzah narrated to us, Shababah narrated to us, Warqa' narrated to us, from Abu Najih, from Mujahid, regarding His saying: "...and a Muhaymin over it," he said: Entrusted with the Qur'an.
His saying, the Exalted: "So judge between them"
[6479] Ahmad ibn 'Uthman ibn Hakim reported to us in what he wrote to me, Ahmad ibn Mufaddal narrated to us, Asbat narrated to us, from al-Suddi regarding His saying: "So judge between them by what Allah has revealed," he said: He commanded Muhammad to judge between them.
His saying, the Exalted: "...by what Allah has revealed"
[6480] My father narrated to us, Abu Salih narrated to us, Mu'awiyah narrated to me, from 'Ali, from Ibn 'Abbas regarding His saying: "So judge between them by what Allah has revealed," he said: By the prescribed punishments (hudud) of Allah, the Exalted and Majestic.
His saying, the Exalted: "...and do not follow their inclinations away from what has come to you of the truth"
[6481] Muhammad ibn 'Ammar narrated to us, Sa'id ibn Sulayman narrated to us, 'Abbad ibn al-'Awwam narrated to us, from Sufyan ibn Husayn, from al-Hakam, from Mujahid, from Ibn 'Abbas, he said: The Prophet (may Allah bless him and grant him peace) was given the choice; if he wished, he could judge between them, and if he wished, he could turn away from them. So he referred them to their own judgments, then [the verse] was revealed: "And judge between them by what Allah has revealed and do not follow their inclinations." Thus, the Messenger of Allah (may Allah bless him and grant him peace) was commanded to judge between them by what is in our Book.
His saying, the Exalted: "To each of you We have appointed a Shar'ah (law/way)"

[6482] Abu Sa'id al-Ashajj narrated to us, Abu Khalid al-Ahmar narrated to us, from Yusuf ibn Abi Ishaq, from his father, from al-Tamimi, from Ibn 'Abbas regarding His saying: "Shar'ah," he said: A path (sabil). A similar [report] was narrated from Mujahid (in one of his two views), al-Suddi, Abu Ishaq al-Hamdani, 'Ikrimah, and al-Dahhak.
[The second view]
[6483] Hajjaj ibn Hamzah narrated to us, Shababah narrated to us, Warqa' narrated to us, from Ibn Abi Najih, from Mujahid regarding His saying: "Shar'ah," he said: A Sunnah (tradition/method). A similar [report] was narrated from al-Hasan (in one of the two narrations) and 'Ata' al-Khurasani.

وَالْوَجْهُ الثَّانِي:
٦٤٧٨ - حَدَّثَنَا حَجَّاجُ بْنُ حَمْزَةَ ثنا شَبَابَةُ ثنا وَرْقَاءُ عَنْ أَبِي نَجِيحٍ عَنْ مُجَاهِدٍ قَوْلَهُ: مُهَيْمِنًا عَلَيْهِ قَالَ: مُؤْتَمَنًا عَلَى الْقُرْآنِ.
قَوْلُهُ تَعَالَى: فَاحْكُمْ بَيْنَهُمْ
٦٤٧٩ - أَخْبَرَنَا أَحْمَدُ بْنُ عُثْمَانَ بْنِ حَكِيمٍ فِيمَا كَتَبَ إِلَيَّ ثنا أَحْمَدُ بْنُ مُفَضَّلٍ ثنا أَسْبَاطٌ عَنِ السُّدِّيِّ قَوْلَهُ: فَاحْكُمْ بَيْنَهُمْ بِمَا أَنْزَلَ اللَّهُ قَالَ: أَمَرَ مُحَمَّدًا عَلَى أَنْ يَحْكُمَ بَيْنَهُمْ.
قَوْلُهُ تَعَالَى: بِمَا أَنْزَلَ اللَّهُ
٦٤٨٠ - حَدَّثَنَا أَبِي ثنا أَبُو صَالِحٍ حَدَّثَنِي مُعَاوِيَةُ عن علي عن بن عَبَّاسٍ قَوْلَهُ:
فَاحْكُمْ بَيْنَهُمْ بِمَا أَنْزَلَ اللَّهُ قَالَ: بِحُدُودِ اللَّهِ عَزَّ وَجَلَّ.
قَوْلُهُ تَعَالَى: وَلَا تَتَّبِعْ أَهْوَاءَهُمْ عَمَّا جَاءَكَ مِنَ الْحَقِّ
٦٤٨١ - حَدَّثَنَا مُحَمَّدُ بْنُ عَمَّارٍ ثنا سَعِيدُ بْنُ سُلَيْمَانَ ثنا عَبَّادُ بْنُ الْعَوَّامِ عَنْ سُفْيَانَ بْنِ حُسَيْنٍ عَنِ الْحَكَمِ عَنْ مُجَاهِدٍ عَنِ ابْنِ عَبَّاسٍ قَالَ: كَانَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مُخَيَّرًا إِنْ شَاءَ حَكَمَ بَيْنَهُمْ وَإِنْ شَاءَ أَعْرَضَ عَنْهُمْ. فَرَدَّهُمْ إِلَى أَحْكَامِهِمْ فَنَزَلَتْ وَأَنِ احْكُمْ بَيْنَهُمْ بِمَا أَنْزَلَ اللَّهُ وَلا تَتَّبِعْ أَهْوَاءَهُمْ فَأُمِرَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ يَحْكُمَ بَيْنَهُمْ بِمَا فِي كِتَابِنَا.
قَوْلُهُ تَعَالَى: لِكُلٍّ جَعَلْنَا مِنْكُمْ شرعة

٦٤٨٢ - حَدَّثَنَا أَبُو سَعِيدٍ الأَشَجُّ ثنا أَبُو خَالِدٍ الأَحْمَرُ عَنْ يُوسُفَ بْنِ أَبِي إِسْحَاقَ عَنْ أبيه عن التميمي عن بن عَبَّاسٍ قَوْلَهُ: شِرْعَةً قال: سَبِيلا وَرُوِيَ عَنْ مُجَاهِدٍ «١» فِي أَحَدِى قَوْلَيْهِ وَالسُّدِّيِّ وَأَبِي إِسْحَاقَ الْهَمْدَانِيِّ وَعِكْرِمَةَ وَالضَّحَّاكِ مِثْلُ ذَلِكَ.
وَالْوَجْهُ الثَّانِي:
٦٤٨٣ - حَدَّثَنَا حَجَّاجُ بْنُ حَمْزَةَ ثنا شَبَابَةُ ثنا وَرْقَاءُ عَنِ ابْنِ أَبِي لجيج عَنْ مُجَاهِدٍ «٢»
