8018 - Abu 'Abd Allah Muhammad ibn Hammad al-Tahrani told me, Hafs ibn 'Umar informed us, al-Hakam ibn Aban told us from 'Ikrimah: Ibn 'Abbas said: "Whoever is forced, let him eat of it only as much as sustains him, and let him not eat his fill."
8019 - My father told us, Abu Salih told us, Mu'awiyah ibn Salih told me from 'Ali ibn Abi Talhah from Ibn 'Abbas regarding His saying: "But whoever is forced [by necessity], neither desiring [it] nor transgressing [it]," he says: "Whoever eats something of this while he is forced, there is no blame upon him; and whoever eats it while not being forced, he has indeed desired [it] and transgressed."
His saying: "Neither desiring [it]."

8020 - Abu Sa'id al-Ashaj told us, Abu Khalid al-Ahmar told us, from Hajjaj, from al-Qasim ibn Abi Bazzah, from Mujahid: "Neither desiring [it] [ghayra baghin]"—he said: "The rebel [al-baghi] against the Imams."
8021 - My father told us, Abu Hudhayfah told us, Shibl told us, from Ibn Abi Najih, from Mujahid regarding "But whoever is forced [by necessity], neither desiring [it] nor transgressing [it]"—he says: "Neither a highway robber nor one who departs from the Imams, or [is] in disobedience to Allah: there is no concession for him, even if he is forced into it."
8022 - Abu Zur'ah told us, Muhammad ibn Sa'id al-Asbahani told us, Sharik informed us, from Salim, from Sa'id ibn Jubayr regarding His saying: "But whoever is forced [by necessity], neither desiring [it] nor transgressing [it]"—he said: "The one who cuts the road (highway robber); there is no concession for him, when he is hungry, to eat carrion, and when he is thirsty, to drink wine."
The second aspect:
8023 - Abu Zur'ah told us, Yahya ibn 'Abd Allah told us, Ibn Lahi'ah told us, 'Ata' told me from Sa'id ibn Jubayr regarding the saying of Allah: "Neither desiring [it] [ghayra baghin]," meaning: "Not seeking to make it lawful." Something similar was narrated from Muqatil ibn Hayyan.
The third aspect:
8024 - Abu Zur'ah told us, 'Amr ibn Hammad told us, Asbat told us, from al-Suddi: "But whoever is forced [by necessity], neither desiring [it] nor transgressing [it]"—as for desiring [it], he desires it for his own pleasure.
8025 - 'Isam ibn Rawwad told us, Adam told us, Damrah told us, from 'Uthman ibn 'Ata', from his father regarding His saying: "But whoever is forced [by necessity], neither desiring [it]"—he said: "He shall not roast the carrion to satisfy his desire, nor shall he eat except that which is hanging [to survive], and he shall carry with him that which will bring him to a lawful source; when he reaches it, he shall discard it."

٨٠١٨ - حَدَّثَنِي أَبُو عَبْدِ اللَّهِ مُحَمَّدُ بْنُ حَمَّادٍ الطِّهْرَانِيُّ أَنْبَأَ حَفْصُ بْنُ عُمَرَ ثنا الْحَكَمُ بْنُ أَبَانَ عَنْ عِكْرِمَةَ: قَالَ ابْنُ عَبَّاسٍ: فَمَنِ اضْطُرَّ فَلْيَأْكُلْ مِنْهُ الشَّيْءَ قَدْرَ مَا يَسُدُّهُ، وَلا يَشْبَعْ مِنْهُ.
٨٠١٩ - حَدَّثَنَا أَبِي ثنا أَبُو صَالِحٍ حَدَّثَنِي مُعَاوِيَةُ بْنُ صَالِحٍ عَنْ عَلِيِّ بْنِ أَبِي طَلْحَةَ عَنِ ابْنِ عَبَّاسٍ: قَوْلِهِ: فَمَنِ اضْطُرَّ غَيْرَ بَاغٍ وَلا عَادٍ يَقُولُ: مَنْ أَكَلَ شَيْئًا مِنْ هَذِهِ وَهُوَ مُضْطَرٌّ- فَلا حَرَجَ، وَمَنْ أَكَلَهُ وَهُوَ غَيْرُ مُضْطَرٍّ فَقَدْ بَغَى وَاعْتَدَى.

٨٠٢١ - حَدَّثَنَا أَبِي ثنا أَبُو حُذَيْفَةَ ثنا شِبْلٌ عَنِ ابْنِ أَبِي نَجِيحٍ عَنْ مُجَاهِدٍ: فَمَنِ اضْطُرَّ غَيْرَ بَاغٍ وَلا عَادٍ، يَقُولُ: لَا قَاطِعًا لِلسَّبِيلِ وَلا مُفَارِقًا لِلأَئِمَّةِ، أَوْ فِي مَعْصِيَةٍ اللَّهِ: لَا رُخْصَةَ لَهُ وَإِنِ اضْطُرَّ إِلَيْهِ.
٨٠٢٢ - حَدَّثَنَا أَبُو زُرْعَةَ ثنا مُحَمَّدُ بْنُ سَعِيدٍ الأَصْبَهَانِيُّ أَنْبَأَ شَرِيكٌ عَنْ سَالِمٍ عَنْ سَعِيدِ بْنِ جُبَيْرٍ: قَوْلِهِ: فَمَنِ اضْطُرَّ غَيْرَ بَاغٍ وَلا عَادٍ، قَالَ: الَّذِي يَقْطَعُ الطَّرِيقَ، فَلا رُخْصَةَ لَهُ إِذَا جَاعَ أَنْ يَأْكُلَ الْمَيْتَةَ، وَإِذَا عَطِشَ أَنْ يَشْرَبَ الْخَمْرَ.

٨٠٢٣ - حَدَّثَنَا أَبُو زُرْعَةَ ثنا يَحْيَى بْنُ عَبْدِ اللَّهِ ثنا ابْنُ لَهِيعَةَ حَدَّثَنِي عَطَاءٌ عَنِ سَعِيدِ ابن جُبَيْرٍ، قَوْلُ اللَّهِ: غَيْرَ بَاغٍ، يَعْنِي: غَيْرَ مُسْتُحِلِّهِ. وَرُوِيَ عَنْ مُقَاتِلِ بْنِ حَيَّانَ نَحْوُ ذَلِكَ.
الْوَجْهُ الثَّالِثُ:
٨٠٢٤ - حَدَّثَنَا أَبُو زُرْعَةَ ثنا عَمْرُو بْنُ حَمَّادٍ ثنا أَسْبَاطٌ عَنِ السُّدِّيِّ: فَمَنِ اضْطُرَّ غَيْرَ بَاغٍ وَلا عَادٍ، أَمَّا بَاغٍ فَيَبْغِي فِيهِ شَهْوَتَهُ.
قَوْلُهُ: فَمَنِ اضْطُرَّ غَيْرَ بَاغٍ، قَالَ: لَا يَشْوِي مِنَ الْمَيْتَةِ لِيَشْتَهِيَهُ وَلا يَأْكُلُ إِلا الْمُعَلَّقَةَ، وَيَحْمِلُ مَعَهُ مَا يُبَلِّغُهُ الْحَلالَ، فَإِذَا بَلَغَهُ أَلْقَاهُ.
