9093 - My father narrated to us, Ibrahim ibn Mahdi al-Missisi narrated to us, al-Mu'tamir ibn Sulayman narrated to us, from his father, from Hanash, from Ikrimah, from Ibn Abbas, who said: The Messenger of Allah (peace be upon him) said: "I have refrained on your behalf from the dregs of the hands (i.e., what people wash off their hands), because you have in the one-fifth of the one-fifth what suffices or satisfies you."
9094 - My father narrated to us, Sahl ibn Uthman narrated to us, Yahya ibn Abi Za'idah narrated to us, from Muhammad ibn Ishaq, from al-Zuhri and Abdullah ibn Abi Bakr, that the Prophet (peace be upon him) divided the share of the near of kin from Khaybar among the Banu Hashim and Banu al-Muttalib. Ibn Ishaq said: He divided for them the one-fifth of the one-fifth.
It was narrated from Abdullah ibn Buraydah and al-Suddi, both of whom said: The Banu Abd al-Muttalib.
The Second Aspect:
9095 - Ahmad ibn Sinan narrated to us, Abd al-Rahman ibn Mahdi narrated to us, Sufyan narrated to us, from Qays ibn Muslim, he said: I asked al-Hasan about His saying: "And know that anything you take as booty, then for Allah is one-fifth of it and for the Messenger and for the near of kin." He said: People differed after the death of the Messenger of Allah (peace be upon him) regarding these two shares; some said the share of the kin is for the kin of the Prophet (peace be upon him), and some said it is for the kin of the Caliph.
It was narrated from Sa'id ibn Jubayr and Ikrimah, both of whom said: The kin of the Prophet (peace be upon him).
9096 - My father narrated to us, Hudbah narrated to us, Hammam narrated to us, from Qatadah, he said: al-Hasan said regarding the share of the near of kin: It is for the kin of the Caliphs; and Ikrimah said: It is for the kin of the Prophet (peace be upon him).
His saying, the Almighty: "And the orphans"
9097 - My father narrated to us, Abu Salih narrated to us, Mu'awiyah ibn Salih narrated to us, from Ali ibn Abi Talhah, from Ibn Abbas regarding the saying of Allah: "And know that anything you take as booty, then for Allah is one-fifth of it and for the Messenger and for the near of kin and the orphans." The booty would be divided into five fifths, and one fifth would be divided into four fifths; a quarter for Allah, the Messenger, and the near of kin, and the second quarter for the orphans.
His saying, the Almighty: "And the needy"
9098 - Through the same chain, from Ibn Abbas regarding the saying of Allah: "Then for Allah is one-fifth of it and for the Messenger and for the near of kin and the orphans and the needy." He said: The booty would be divided into five fifths: four of them between those who fought for it, and one fifth would be divided into four: a quarter for Allah, the Messenger, and the near of kin; the second quarter for the orphans; and the third quarter for the needy.

٩٠٩٣ - حَدَّثَنَا أَبِي حَدَّثَنَا إِبْرَاهِيمُ بْنُ مَهْدِيِّ الْمِصِّيصِيُّ ثنا الْمُعْتَمِرُ بْنُ سُلَيْمَانَ عَنْ أَبِيهِ عَنْ حَنَشٍ عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ رَغِبَتُ لَكُمْ عَنْ غُسَالَةِ الأَيْدِي، لأَنَّ لَكُمْ فِي خُمْسِ الْخُمْسِ مَا يُغْنِيكُمْ أَوْ يَكْفِيكُمْ «١»
٩٠٩٤ - حَدَّثَنَا أَبِي ثنا سَهْلُ بْنُ عُثْمَانَ ثنا يَحْيَى بْنُ أَبِي زَائِدَةَ عَنْ مُحَمَّدِ بْنِ إِسْحَاقَ عَنِ الزُّهْرِيِّ وَعَبْدِ اللَّهِ بْنِ أَبِي بَكْرٍ أَنَّ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَسَمَ سَهْمُ ذِي الْقُرْبَى مِنْ خَيْبَرَ عَلَى بَنِي هَاشِمٍ وَبَنِي الْمُطَّلِبِ، قَالَ ابْنُ إِسْحَاقَ: قَسَمَ لَهُمْ خُمْسَ الْخُمْسِ
وَرُوِيَ عَنْ عَبْدِ اللَّهِ بْنِ بُرَيْدَةَ وَالسُّدِّيِّ، قَالا: بَنِي عَبْدِ الْمُطَّلِبِ.
الْوَجْهُ الثَّانِي:
٩٠٩٥ - حَدَّثَنَا أَحْمَدُ بْنُ سِنَانٍ ثنا عَبْدُ الرَّحْمَنِ بْنُ مَهْدِيٍّ ثنا سُفْيَانُ عَنِ قَيْسِ بْنِ مُسْلِمٍ قَالَ: سَأَلْتُ الْحَسَنَ عَنْ قَوْلِهِ: وَاعْلَمُوا أَنَّمَا غَنِمْتُمْ مِنْ شَيْءٍ فَأَنَّ لِلَّهِ خُمُسَهُ وَلِلرَّسُولِ وَلِذِي الْقُرْبَى قَالَ: اخْتَلَفَ النَّاسُ بَعْدَ وَفَاةِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي هَذَيْنِ السَّهْمَيْنِ، فَقَالَ قَائِلُونَ: سَهْمُ الْقَرَابَةِ لَقَرَابَةِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، وَقَالَ قَائِلُونَ: لَقَرَابَةِ الْخَلِيفَةِ.
وَرُوِيَ عَنْ سَعِيدِ بْنِ جُبَيْرٍ وَعِكْرِمَةَ، قَالا:
قَرَابَةِ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ.
٩٠٩٦ - حَدَّثَنَا أَبِي ثَنَا هُدْبَةُ حَدَّثَنَا هَمَّامٌ عَنْ قَتَادَةَ قَالَ: قَالَ الْحَسَنُ فِي سَهْمِ ذِي الْقُرْبَى: هُوَ لَقَرَابَةِ الْخُلَفَاءِ وَقَالَ عِكْرِمَةُ هُوَ لَقَرَابَةِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ.
قَوْلُهُ تَعَالَى: وَالْيَتَامَى
٩٠٩٧ - حَدَّثَنَا أَبِي ثنا أَبُو صَالِحٍ ثنا مُعَاوِيَةُ بْنُ صَالِحٍ عَنْ عَلِيِّ بْنِ أَبِي طَلْحَةَ عَنِ ابْنِ عَبَّاسٍ فِي قَوْلِ اللَّهِ: وَاعْلَمُوا أَنَّمَا غَنِمْتُمْ مِنْ شَيْءٍ فَأَنَّ لِلَّهِ خُمُسَهُ وَلِلرَّسُولِ وَلِذِي الْقُرْبَى وَالْيَتَامَى فَكَانَتِ الْغَنِيمَةُ تُقْسَمُ عَلَى خَمْسَةِ أَخْمَاسٍ، وَخُمْسٌ وَاحِدٌ يُقْسَمُ عَلَى أَرْبَعَةِ أَخْمَاسٍ، فَرُبْعٌ لِلَّهِ وَلِلرَّسُولِ وَلِذِي الْقُرْبَى وَالرُّبْعُ الثَّانِي لِلْيَتَامَى.
قَوْلُهُ تَعَالَى: وَالْمَسَاكِينُ
٩٠٩٨ - وَبِهِ عَنِ ابْنِ عَبَّاسٍ فِي قَوْلِ اللَّهِ: فَأَنَّ لِلَّهِ خُمُسَهُ وَلِلرَّسُولِ وَلِذِي الْقُرْبَى وَالْيَتَامَى وَالْمَسَاكِينِ قَالَ: كَانَتِ الْغَنِيمَةُ تُقْسَمُ عَلَى خَمْسَةِ أَخْمَاسٍ: فَأَرْبَعَةٌ مِنْهَا بَيْنَ مَنْ قَاتَلَ عَلَيْهَا، وَخُمْسٌ وَاحِدٌ يُقْسَمُ عَلَى أَرْبَعَةٍ: فَرُبْعٌ لِلَّهِ وَلِلرَّسُولِ وَلِذِي الْقُرْبَى، وَالرُّبْعُ الثَّانِي: لِلْيَتَامَى، وَالرُّبْعُ الثَّالِثُ: للمساكين.
