14092 - Al-Hasan ibn Muhammad ibn al-Sabah narrated to us, Hajjaj narrated to us, from Ibn Jurayj and 'Uthman ibn 'Ata', from 'Ata', from Ibn 'Abbas regarding His saying: "Confine them to houses," he said: "This indecency was [addressed] in these verses before Surah al-Nur was revealed concerning lashing and stoning. If she commits a clear indecency today, she is taken out and stoned with stones. Thus, this verse abrogated it: 'The fornicatress and the fornicator, so flog each of them one hundred lashes.'"
14093 - Abu Zur'ah narrated to us, Yahya ibn 'Abd Allah ibn Bukayr narrated to us, Ibn Lahi'ah narrated to me, 'Ata' narrated to me, from Sa'id ibn Jubayr regarding the saying of Allah: "The fornicatress and the fornicator, so flog each of them one hundred lashes," he said: "This means if they are both virgins who have not been previously married, the authorities shall flog them if [the matter] is brought before them and four free, upright Muslim [men] bear witness."
14094 - And with the same chain of transmission, from Sa'id ibn Jubayr regarding the saying of Allah: "And do not let pity for them hold you," meaning: in their flogging.
His saying: "Pity."
14095 - 'Amr ibn 'Abd Allah al-Awdi narrated to us, Waki' narrated to us, from Nafi' ibn 'Umar, from Ibn Abi Mulaykah, from 'Ubayd Allah ibn 'Abd Allah ibn 'Umar that a slave girl of Ibn 'Umar committed fornication, so he struck her legs. Nafi' said: "I think he said: 'And her back.'" He said: "I said: 'And do not let pity for them hold you in the religion of Allah.' He said: 'My son, her lashing is on her head [i.e., her person], and I have caused pain where I struck.'"
14096 - 'Amr al-Awdi informed us, Waki' narrated to us, from Sufyan (1), from Ibn Abi Najih, from Mujahid (2). He said: "'And do not let pity for them hold you in the religion of Allah.' He said: 'Pity is [the refusal to] establish the legal punishments (hudud) when they are brought to the ruler.'"
14097 - Abu Sa'id al-Ashajj narrated to us, Waki' narrated to us, from Sufyan, from Ibn Abi Najih, from Mujahid: "'And do not let pity for them hold you in the religion of Allah.' He said: 'The punishment is to be established and not suspended.'"
14098 - Abu Sa'id al-Ashajj narrated to us, Ibn Fudayl narrated to us, from Dawud ibn Abi Hind, from Sa'id ibn Jubayr: "'And do not let pity for them hold you in the religion of Allah.' He said: 'The flogging.'"

١٤٠٩٢ - حَدَّثَنَا الْحَسَنُ بْنُ مُحَمَّدِ بْنِ الصَّبَّاحِ، ثنا حجاج، عن ابن جريج وعثمان ابن عَطَاءٍ، عَنْ عَطَاءٍ، عَنِ ابْنِ عَبَّاسٍ فِي قَوْلِهِ: فَأَمْسِكُوهُنَّ فِي الْبُيُوتِ قَالَ: فَكَانَ ذَلِكَ الْفَاحِشَةُ فِي هَؤُلاءِ الآيَاتِ قَبْلَ أَنْ تَنْزِلَ سُورَةُ النُّورِ فِي الْجِلْدِ الرجم، فَإِنْ جَاءَتِ الْيَوْمَ بِفَاحِشَةٍ بَيِّنَةٍ، فَإِنَّهَا تَخْرُجُ وَتُرْجَمُ بِالْحِجَارَةِ، فَنَسَخَتْهَا هَذِهِ الآيَةُ: الزَّانِيَةُ وَالزَّانِي فَاجْلِدُوا كُلَّ وَاحِدٍ مِنْهُمَا مِائَةَ جَلْدَةٍ.
١٤٠٩٣ - حَدَّثَنَا أَبُو زُرْعَةَ، حَدَّثَنَا يَحْيَى بْنُ عَبْدِ اللَّهِ بْنِ بُكَيْرٍ، حَدَّثَنِي ابْنُ لَهِيعَةَ، حَدَّثَنِي عَطَاءٌ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ فِي قَوْلِ اللَّهِ: الزَّانِيَةُ وَالزَّانِي فَاجْلِدُوا كُلَّ وَاحِدٍ مِنْهُمَا مِائَةَ جَلْدَةٍ يًعْنِى إِذَا كَانَا بِكْرَيْنِ لَمْ يُحْصِنَا يَجْلِدُهُمَا الْحُكَّامُ إِذَا رُفِعَ إِلَيْهِمْ وَشَهِدَ أَرْبَعَةٌ مِنَ الْمُسْلِمِينَ أَحْرَارٌ عُدُولٌ.
١٤٠٩٤ - وَبِهِ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ فِي قَوْلِ اللَّهِ: وَلا تَأْخُذْكُمْ بِهِمَا يًعْنِى: فِي ضَرْبِهِمَا.
قَوْلُهُ: رَأْفَةٌ.
١٤٠٩٥ - حَدَّثَنَا عَمْرُو بْنُ عَبْدِ اللَّهِ الأَوْدِيُّ، ثنا وَكِيعٌ، عَنْ نَافِعِ بْنِ عُمَرَ، عَنِ ابْنِ أَبِي ملكية، عن عبيد الله بن عبد الله ابن عُمَرَ أَنَّ جَارِيَةً لابْنِ عُمَرَ زَنَتْ، فَضَرَبَ رِجْلَيْهَا، قَالَ نَافِعٌ: أَرَاهُ قَالَ: وَظَهْرَهَا، قَالَ: قُلْتُ: وَلا تَأْخُذْكُمْ بِهِمَا رَأْفَةٌ فِي دِينِ اللَّهِ قَالَ يَا بُنَيَّ جِلْدُهَا فِي رَأْسِهَا، وَقَدْ أَوْجَعْتُ حَيْثُ ضَرَبْتُ.
١٤٠٩٦ - أَخْبَرَنَا عَمْرٌو الأَوْدِيُّ، ثنا وَكِيعٌ، عَنْ سُفْيَانَ «١» ، عَنْ ابْنِ أَبِي نَجِيحٍ، عَنْ مُجَاهِدٍ «٢»
قَالَ: وَلا تَأْخُذْكُمْ بِهِمَا رَأْفَةٌ فِي دِينِ اللَّهِ قَالَ: الرَّأْفَةُ إِقَامَةُ الْحُدُودِ إِذَا رُفِعَتْ إِلَى السُّلْطَانِ.
١٤٠٩٧ - حَدَّثَنَا أَبُو سَعِيدٍ الأَشَجُّ، ثنا وَكِيعٌ، عَنْ سُفْيَانُ، عَنِ ابْنِ أَبِي نَجِيحٍ، عَنْ مُجَاهِدٍ وَلا تَأْخُذْكُمْ بِهِمَا رَأْفَةٌ فِي دِينِ اللَّهِ قَالَ: الْحَدُّ يُقَامُ وَلا يُعَطَّلُ.
١٤٠٩٨ - حَدَّثَنَا أَبُو سَعِيدٍ الأَشَجُّ، ثنا ابْنُ فُضَيْلٍ، عَنْ دَاوُدَ بْنُ أَبِي هِنْدَ، عَنِ سَعِيدِ بْنِ جُبَيْرٍ وَلا تَأْخُذْكُمْ بِهِمَا رَأْفَةٌ فِي دِينِ اللَّهِ قَالَ: الْجَلْدُ.
