The Fourth Aspect:

14115 - Abu 'Ubayd Allah, the nephew of Ibn Wahb, narrated to us, my uncle narrated to us, Yunus ibn Yazid and Ibn Abi Dhi'b informed us, from al-Zuhri regarding his saying: "And let a party of the believers witness their punishment," he said: "Three people or more."

The Fifth Aspect:

14116 - Abu 'Ubayd Allah, the nephew of Ibn Wahb, narrated to us, my uncle narrated to us, he said: Imam Malik ibn Anas said regarding "And let a party of the believers witness their punishment," he said: "The party, in my view, is four people or more, because there is no testimony in adultery for less than four witnesses or more."

14117 - Muhammad ibn Yahya narrated to us, al-'Abbas ibn al-Walid al-Narsi informed us, Yazid ibn Zuray' narrated to us, Sa'id narrated to us, from Qatadah regarding his saying: "And let a party of the believers witness their punishment," that this may be a lesson, an admonition, and a deterrent.

His saying: "Of the believers."

14118 - Abu Zur'ah narrated to us, Yahya ibn 'Abd Allah ibn Bukayr narrated to us, Ibn Lahi'ah narrated to me, 'Ata' ibn Dinar narrated to me, from Sa'id ibn Jubayr regarding his saying: "The believers," meaning: the attestors (al-musaddiqin).

14119 - Abu 'Abd Allah al-Tahrani informed us in what he wrote to me, 'Abd al-Razzaq informed us (1), Ma'mar narrated to us, from Qatadah regarding his saying: "A party of the believers," he said: "A group of the Muslims."

His saying: "The adulterer does not marry except an adulteress."

14120 - Abu Sa'id al-Ashajj narrated to us, Abu Khalid narrated to us, from Ibn Abi Dhi'b, he said: I heard Shu'bah, the freed slave (mawla) of Ibn 'Abbas, he said: I heard Ibn 'Abbas while a man asked him, saying: "I used to engage in relations with a woman, doing with her what Allah (the Almighty and Majestic) has forbidden for me, then Allah granted me repentance from that, and I wished to marry her, but people said: 'The adulterer does not marry except an adulteress.'" Ibn 'Abbas said: "This does not apply to this case; marry her, and whatever sin occurred is upon me."

14121 - Ahmad ibn Sinan al-Wasiti narrated to us, 'Abd al-Rahman narrated to us, from Sufyan (2), from Habib ibn Abi 'Amrah, from Sa'id ibn Jubayr, from Ibn 'Abbas:

١٤١١٥ - حَدَّثَنَا أَبُو عُبَيْدِ اللَّهِ ابْنُ أَخِي ابْنِ وَهْبٍ، ثنا عَمِّي، أنبأ يُونُسُ ابن يَزِيدَ وَابْنُ أَبِي ذِئْبٍ، عَنِ الزُّهْرِيِّ: يَعْنِى قوله: وليشهد عذابهما طائفة من المؤمنين قَالَ: ثَلَاثَةُ نَفَرٍ فَصَاعِدًا.

وَالْوَجْهُ الْخَامِسُ:

١٤١١٦ - حَدَّثَنَا أَبُو عُبَيْدِ اللَّهِ ابْنُ أَخِي ابْنِ وَهْبٍ، ثنا عَمِّي، قَالَ: قَالَ: الإِمَامُ مَالِكُ بْنُ أَنَسٍ وَلْيَشْهَدْ عَذَابَهُمَا طَائِفَةٌ مِنَ الْمُؤْمِنِينَ قَالَ: الطَّائِفَةُ أَرَى أَرْبَعَةَ نَفَرٍ فَصَاعِدًا، لأَنَّهُ لَا تَكُونُ شَهَادَةٌ فِي الزِّنَا دُونَ أَرْبَعَةِ شُهَدَاءَ فَصَاعِدًا.

١٤١١٧ - حَدَّثَنَا مُحَمَّدُ بْنُ يَحْيَى، أَنْبَأَ الْعَبَّاسُ بْنُ الْوَلِيدِ النَّرْسِيُّ، ثنا يَزِيدُ بْنُ زُرَيْعٍ، ثنا سَعِيدٌ، عَنْ قَتَادَةَ قَوْلُهُ: وَلْيَشْهَدْ عَذَابَهُمَا طَائِفَةٌ مِنَ الْمُؤْمِنِينَ لِيَكُونَ ذَلِكَ عِبْرَةً وموعظة، نكالا.

قَوْلُهُ: مِنَ الْمُؤْمِنِينَ.

١٤١١٨ - حَدَّثَنَا أَبُو زُرْعَةَ، ثنا يَحْيَى بْنُ عَبْدِ اللَّهِ بْنِ بُكَيْرٍ، حَدَّثَنِي ابْنُ لَهِيعَةَ حَدَّثَنِي عَطَاءُ بْنُ دِينَارٍ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، فِي قَوْلِهِ: الْمُؤْمِنِينَ يَعْنِى الْمُصَدِّقِينَ.

١٤١١٩ - أَخْبَرَنَا أَبُو عَبْدِ اللَّهِ الطِّهْرَانِيُّ فِيمَا كَتَبَ إِلَيَّ، أَنْبَأَ عَبْدُ الرَّزَّاقِ «١» ، ثنا مَعْمَرٌ، عَنْ قَتَادَةَ فِي قَوْلِهِ: طَائِفَةٌ مِنَ الْمُؤْمِنِينَ قَالَ: نَفَرٌ مِنَ الْمُسْلِمِينَ.

قَوْلُهُ: الزَّانِي لَا يَنْكِحُ إِلا زَانِيَةً.

١٤١٢٠ - حَدَّثَنَا أَبُو سَعِيدٍ الأَشَجُّ، ثنا أَبُو خَالِدٍ، عَنِ ابْنِ أَبِي ذِئْبٍ قَالَ: سَمِعْتُ شُعْبَةَ مَوْلَى ابْنِ عَبَّاسٍ، قَالَ: سَمِعْتُ ابْنَ عَبَّاسٍ وَرَجُلٌ سَأَلَهُ فَقَالَ: إِنِّي كُنْتُ أُلِمُّ بِامْرَأَةٍ آتِي مِنْهَا مَا حَرَّمَ اللَّهُ عَزَّ وَجَلَّ عَلَيَّ، فَرَزَقَنِي اللَّهُ مِنْ ذَلِكَ تَوْبَةً، فَأَرَدْتُ أَنْ أَتَزَوَّجَهَا، فَقَالَ أُنَاسٌ: إِنَّ الزَّانِيَ لَا يَنْكِحُ إِلَّا زَانِيَةً، فَقَالَ ابْنُ عَبَّاسٍ: لَيْسَ هَذَا فِي هَذَا، انْكِحْهَا فَمَا كَانَ مِنْ إِثْمٍ فَعَلَيَّ.

١٤١٢١ - حَدَّثَنَا أَحْمَدُ بْنُ سِنَانٍ الْوَاسِطِيُّ، ثنا عَبْدُ الرَّحْمَنِ، عَنْ سُفْيَانَ «٢» ، عَنْ حَبِيبِ بْنِ أَبِي عَمْرَةَ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، عَنِ ابْنِ عَبَّاسٍ:
