Ibn Shaqiq, Muhammad ibn Muzahim narrated to us, Bukayr ibn Ma'ruf narrated to us, from Muqatil ibn Hayyan, regarding His saying: "The adulterer does not marry except an adulteress or a polytheist, and the adulteress does not marry anyone except an adulterer or a polytheist; and that has been made unlawful for the believers." He said: When the Emigrants (Muhajirun) arrived in Medina, they arrived in a state of hardship, except for a few of them, and Medina was high-priced and in severe distress, with little wealth in it. In the market, there were known prostitutes among the People of the Scripture, and among the slave women of the Ansar were Umayyah, the slave girl of 'Abdullah ibn Ubayy, and Musaykiyah, daughter of Umayyah, who belonged to a man from the Ansar. There were prostitutes among the slave girls of the Ansar, and every woman among them had raised a mark on her door, like the mark of a veterinarian, so that it would be known that she was a hired prostitute. They were among the most prosperous people of Medina and had the most wealth. Some of the Muslim Emigrants desired what they earned due to the hardship they were in, so some of them suggested to others: "If we were to marry some of these prostitutes, we would obtain a portion of their surplus food." Some of them said: "We will consult the Messenger of Allah (may Allah bless him and grant him peace)." They came to him and said: "O Messenger of Allah, hardship has weighed heavily upon us, and we do not find anything to eat. In the market, there are prostitutes among the women of the People of the Scripture, their slave girls, and the slave girls of the Ansar who earn for themselves. Is it permissible for us to marry them so we may benefit from the surplus of what they earn, and when we find sufficiency, we will leave them?" Then Allah (the Almighty and Majestic) revealed to His Prophet (may Allah bless him and grant him peace) that this is unlawful for the believers—that they should marry the adulteresses who commit illicit sexual acts and make their adultery public. He said: "The adulterer among the people of the Qibla does not marry except an adulteress from the prostitutes among the slave girls of the Ansar, or an adulteress who has been flogged for adultery among the people of the Qibla, or a polytheist from the People of the Scripture—a Jewess or a Christian—from the prostitutes among the slave girls of the Ansar."
14129 - Muhammad ibn Sa'd ibn 'Atiyyah al-'Awfi reported to us in what he wrote to me, my father narrated to me, my paternal uncle narrated to me, my father narrated to me, from his father, from Ibn 'Abbas regarding His saying: "The adulterer does not marry except an adulteress or a polytheist" (the verse), he said: There were houses called "al-mawakhiro" (brothels) in the Jahiliyyah, and they would hire out their young women in them. They were houses known for adultery, and no one would be directed to them, nor would anyone go to them, except an adulterer from the people of the Qibla or a polytheist from the people of the idols. So, Allah made that unlawful for the believers.
14130 - Yunus ibn Habib narrated to us, Abu Dawud narrated to us, Qays narrated to us, from Abu Husayn, from Sa'id ibn Jubayr, from Ibn 'Abbas regarding His saying: "The adulterer does not marry except an adulteress or a polytheist, and the adulteress does not marry anyone except an adulterer or a polytheist," he said: "The adulterer does not commit adultery except with an adulteress or a polytheist, and the adulteress does not have anyone commit adultery with her except an adulterer or a polytheist."

ابن شَقِيقٍ، ثنا مُحَمَّدُ بْنُ مُزَاحِمٍ، ثنا بُكَيْرُ بْنُ مَعْرُوفٍ، عن مقاتل ابن حَيَّانَ. قَوْلُهُ:
الزَّانِي لَا يَنْكِحُ إِلا زَانِيَةً أَوْ مُشْرِكَةً وَالزَّانِيَةُ لَا يَنْكِحُهَا إِلا زَانٍ أَوْ مُشْرِكٌ وَحُرِّمَ ذَلِكَ عَلَى الْمُؤْمِنِينَ قَالَ: لَمَّا قَدِمَ الْمُهَاجِرُونَ الْمَدِينَةَ، قَدِمُوهَا وَهُمْ بِجَهْدٍ، إلا قليل مِنْهُمْ، وَالْمَدِينَةُ غَالِيَةُ السِّعْرِ، شَدِيدَةُ الْجَهْدِ، الْخَيْرُ بِهَا قَلِيلٌ. وَفِي السُّوقِ زَوَانٍ مُتَعَالِمَاتٌ مِنْ أَهْلِ الْكِتَابِ، وَإِمَاءِ الأَنْصَارِ مِنْهُنَّ أُمَيَّةُ وَلِيدَةُ عَبْدِ اللَّهِ بْنِ أُبَيٍّ، وَمُسَيْكِيَةُ بِنْتُ أُمَيَّةَ لِرَجُلٍ مِنَ الأَنْصَارِ. فِي بَغَايَا مِنْ وَلائِدِ الأَنْصَارِ، وَقَدْ رَفَعَتْ كُلُّ امْرَأَةٍ مِنْهُنَّ عَلَى بَابِهَا عَلامَةً كَعَلامَةِ الْبَيْطَارِ لِيُعْرَفَ أَنَّهَا زَانِيَةٌ مُؤَجَّرَةٌ، وَكُنَّ مِنْ أَخْصَبِ أَهْلِ الْمَدِينَةِ وَأَكْثَرِهِ خَيْرًا، فَرَغِبَ أُنَاسٌ مِنَ الْمُهَاجِرِينَ الْمُسْلِمِينَ فِيمَا يَكْتَسِبْنَ، لِلَّذِي هُمْ فِيهِ مِنَ الْجَهْدِ، فَأَشَارَ بَعْضُهُمْ عَلَى بَعْضٍ، لَوْ تَزَوَّجْنَا بَعْضَ هَؤُلاءِ الزواني، فنصيب من فضول أطعماتهن، فَقَالَ بَعْضُهُمْ: نَسْتَأْمِرُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَأَتَوْهُ فَقَالُوا: يَا رَسُولَ اللَّهِ قَدْ شَقَّ عَلَيْنَا الْجَهْدُ، وَلا نَجْدُ مَا نَأْكُلُ، وَفِي السُّوقِ بَغَايَا نِسَاءِ أَهْلِ الْكِتَابِ، وَوَلائِدُهُنَّ وَوَلائِدُ الأَنْصَارِ، يَكْتَسِبْنَ لأَنْفُسِهِنَّ، فَيَصْلُحُ لَنَا أَنْ نَتَزَوَّجَ مِنْهُنَّ، فَنُصِيبَ مِنْ فُضُولِ مَا يَكْتَسِبْنَ، فَإِذَا وَجَدْنَا عَنْهُ غِنًى تَرَكْنَاهُنَّ، فَأَنْزَلَ اللَّهُ عَزَّ وَجَلَّ عَلَى نَبِيِّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِأَنَّ ذَلِكَ حَرَامٌ عَلَى الْمُؤْمِنِينَ، أَنْ يَتَزَوَّجُوا الزَّوَانِيَ الْمُسَافِحَاتِ الْمُعَالِنَاتِ زِنَاهُنَّ، فَقَالَ: الزَّانِي مِنْ أَهْلِ الْقِبْلَةِ لَا يَنْكِحُ إِلا زَانِيَةً مِنْ بَغَايَا وَلائِدِ الأَنْصَارِ، أَوْ زَانِيَةً مَجْلُودَةً فِي الزِّنَا مِنْ أَهْلِ الْقِبْلَةِ، أَوْ مُشْرِكَةً مِنْ أَهْلِ الْكِتَابِ يَهُودِيَّةً أَوْ نَصْرَانِيَّةً، مِنْ بَغَايَا وَلائِدِ الأَنْصَارِ «١» .
١٤١٢٩ - أَخْبَرَنَا مُحَمَّدُ بْنُ سَعْدِ بْنِ عَطِيَّةَ الْعَوْفِيُّ فِيمَا كَتَبَ إِلَيَّ، حَدَّثَنِي أَبِي، حَدَّثَنِي عَمِّي حَدَّثَنِي أَبِي، عَنْ أَبِيهِ، عَنِ ابْنِ عَبَّاسٍ فِي قَوْلِهِ: الزَّانِي لَا يَنْكِحُ إِلَّا زَانِيَةً أَوْ مُشْرِكَةً الْآيَةَ قَالَ: كَانَتْ بُيُوتٌ تُسَمَّى الْمَوَاخِيرَ فِي الْجَاهِلِيَّةِ، وَكَانُوا يُؤَاجِرُونَ فِيهَا فَتَيَاتِهِمْ، وَكَانَتْ بُيُوتٌ مَعْلُومَةَ الزِّنَا، لَا يُدَلُّ عَلَيْهِنَّ وَلا يَأْتِيهِنَّ إِلا زَانٍ مِنْ أَهْلِ الْقِبْلَةِ، أَوْ مُشْرِكٌ مِنْ أَهْلِ الأَوْثَانِ، فَحَرَّمَ اللَّهُ ذَلِكَ عَلَى الْمُؤْمِنِينَ «٢» .
١٤١٣٠ - حَدَّثَنَا يُونُسُ بْنُ حَبِيبٍ، ثنا أَبُو دَاوُدَ، ثنا قَيْسٍ، عَنْ أَبِي حُصَيْنٍ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، عَنِ ابْنِ عَبَّاسٍ فِي قوله: الزَّانِي لَا يَنْكِحُ إِلا زَانِيَةً أَوْ مُشْرِكَةً وَالزَّانِيَةُ لَا يَنْكِحُهَا إِلا زَانٍ أَوْ مُشْرِكٌ
