Translation · EN

He said: He does not commit adultery at the time he commits it except with an adulteress like himself or a polytheist, and she does not commit adultery at the time she commits it except with the likes of herself.

14144 - It was mentioned from Yahya ibn Ma'in al-Qattan, Ubayd Allah ibn al-Akhnas narrated to us, from 'Amr ibn Shu'ayb, from his father, from his grandfather, that Marthad ibn Abi Marthad al-Ghanawi was a strong man. He used to carry captives from Makkah to Madinah. He made a promise to a man to carry him, and there was a remnant in Makkah called 'Anaq, who was his friend. She went out and saw a dark figure in the shadow of a wall, and she said: Who is this? Marthad? I said: Marthad. She said: Welcome, O Marthad! Come and spend the night with us in the settlement. I said: O 'Anaq, Allah has forbidden adultery. She said: O people of the tents! This is the Duldul who carries your captives from Makkah to Madinah. He said: So I traveled the Khandamah, and I entered a cave or a mountain fissure. Eight men sought me and came until they stood over my head, but Allah blinded them to me. So I came to my companion and carried him. When I reached al-Arak with him, I released him, and I came to the Prophet (may Allah bless him and grant him peace) and said: Let me marry 'Anaq. He remained silent regarding me, then [the verse] was revealed: "And the adulteress, no one marries her except an adulterer or a polytheist." So he called me, read it to me, and said: Do not marry her (1).

14145 - My father narrated to us, he said: Abu Mushir mentioned it, Sa'id ibn 'Abd al-'Aziz narrated to us, from Makhul, regarding: "The adulterer does not marry except an adulteress or a polytheist, and the adulteress, no one marries her except an adulterer or a polytheist." He said: The adulterer has his cover removed; he does not marry except an adulteress who has had her cover removed.

14146 - I read to Muhammad ibn al-Fadl, Muhammad ibn 'Ali narrated to us, Muhammad ibn Muzahim narrated to us, Bukayr ibn Ma'ruf narrated to us, from Muqatil ibn Hayyan: "And the adulteress, no one marries her except an adulterer." He said: The adulterer [here refers to] one from the People of the Scripture, and the adulteress, no one marries her except a lashed adulterer from the People of the Qiblah.

14147 - 'Ali ibn al-Hasan al-Hisinjani narrated to us, Musaddad narrated to us, Ibn Abi 'Adi narrated to us, Ibn Jurayj informed us, from 'Ata', regarding His saying: "And the adulteress, no one marries her except an adulterer or a polytheist," he said: Or a polytheist [who is] for them. I said: Did it reach you from Ibn 'Abbas? He said: Yes.

14148 - My father narrated to us, Abu Salih narrated to us, Mu'awiyah ibn Salih narrated to me, from 'Ali ibn Abi Talhah, from Ibn 'Abbas, regarding His saying: "And the adulteress, no one marries her except an adulterer or a polytheist," from other than the people of the Qiblah.

قَالَ: لَا يَزْنِي حِينَ يَزْنِي إِلا بِزَانِيَةٍ مِثْلِهِ أَوْ مُشْرِكَةٍ، وَلا تَزْنِي حِينَ تَزْنِي إلا بمثلها.

١٤١٤٤ - ذكر، عن يحي بن معين الْقَطَّانِ، ثنا عُبَيْدُ اللَّهِ بْنُ الأَخْنَسِ، عَنْ عَمْرُو بْنُ شُعَيْبٍ، عَنْ أَبِيهِ، عَنْ جَدِّهِ، أَنَّ مَرْثَدَ بْنَ أَبِي مَرْثَدٍ الْغَنَوِيَّ كَانَ رَجُلا شَدِيدًا، وَكَانَ يَحْمِلُ الأُسَارَى مِنْ مَكَّةَ إلى المدينة، فوعدت رجلا لأحمله، وكان بمكة بقية، يُقَالُ لَهَا: عَنَاقٌ، وَكَانَتْ صَدِيقَتَهُ، فَخَرَجَتْ، فَرَأَتْ سَوَادًا فِي ظِلِّ حَائِطٍ، فَقَالَتْ:

مَنْ هَذَا؟ مَرْثَدٌ؟ قُلْتُ: مَرْثَدٌ، قَالَتْ: مَرْحَبًا وَأَهْلا يَا مَرْثَدُ: انْطَلِقِ اللَّيْلَةَ فَبِتْ عِنْدَنَا فِي الْحِلِّ. فَقُلْتُ: يَا عَنَاقُ، إِنَّ اللَّهَ قَدْ حَرَّمَ الزنا، قالت: يَا أَهْلَ الْخِيَامِ، هَذَا الدُّلْدُلُ الَّذِي يَحْمِلُ أُسَارَاكُمْ مِنْ مَكَّةَ إِلَى الْمَدِينَةِ، قَالَ: فَسَلَكْتُ الْخَنْدَمَةَ، وَدَخَلْتُ كَهْفًا أَوْ غَارًا، وَطَلَبَنِي ثَمَانِيَةٌ، فَجَاءُوا حَتَّى قَامُوا عَلَى رَأْسِي، فَعَمَاهُمُ اللَّهُ عَنِّي، فَجِئْتُ إِلَى صَاحِبِي، فَحَمَلْتُهُ، فَلَمَّا انْتَهَيْتُ بِهِ الأَرَاكَ فَكَكْتُ عَنْهُ، وَجِئْتُ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقُلْتُ: أَنْكِحْنِي عَنَاقًا، فَسَكَتَ عَنِّي فَنَزَلَتْ وَالزَّانِيَةُ لَا يَنْكِحُهَا إِلا زَانٍ أَوْ مُشْرِكٌ فَدَعَانِي وَقَرَأَهَا عَلَيَّ، وَقَالَ: لَا تَنْكِحْهَا «١» .

١٤١٤٥ - حَدَّثَنَا أَبِي، قَالَ: ذَكَرَهُ أَبُو مُسْهِرٍ، ثنا سَعِيدُ بْنُ عَبْدِ الْعَزِيزِ، عَنْ مَكْحُولٍ الزَّانِي لَا يَنْكِحُ إِلا زَانِيَةً أَوْ مُشْرِكَةً وَالزَّانِيَةُ لَا يَنْكِحُهَا إِلا زَانٍ أَوْ مُشْرِكٌ قَالَ:

الزَّانِي مَكْشُوفٌ سِتْرُهُ، لَا يَنْكِحُ إِلا زَانِيَةً مَكْشُوفًا سِتْرُهَا.

١٤١٤٦ - قَرَأْتُ عَلَى مُحَمَّدِ بْنِ الْفَضْلِ، ثنا مُحَمَّدُ بْنُ عَلِيٍّ، ثنا مُحَمَّدُ ابن مُزَاحِمٍ، ثنا بُكَيْرُ بْنُ مَعْرُوفٍ، عَنْ مُقَاتِلِ بْنِ حَيَّانَ: وَالزَّانِيَةُ لَا يَنْكِحُهَا إِلا زَانٍ قَالَ: وَالزَّانِي مِنْ أَهْلِ الْكِتَابِ وَالزَّانِيَةُ لَا يَنْكِحُهَا إِلا زَانٍ مَجْلُودٌ مِنْ أَهْلِ الْقِبْلَةِ.

١٤١٤٧ - حَدَّثَنَا عَلِيُّ بْنُ الْحَسَنِ الْهِسِنْجَانِيُّ، ثنا مُسَدَّدٌ، ثنا ابْنُ أَبِي عَدِيٍّ، أنبأ ابْنُ جُرَيْجٍ، عَنْ عَطَاءٍ، قَوْلُهُ: وَالزَّانِيَةُ لَا يَنْكِحُهَا إِلا زَانٍ أَوْ مُشْرِكٌ قَالَ: أَوْ مُشْرِكٌ لَهُنَّ، قُلْتُ: أَبَلَغَكَ، عَنِ ابْنِ عَبَّاسٍ؟ قَالَ: نَعَمْ.

١٤١٤٨ - حَدَّثَنَا أَبِي، ثنا أَبُو صَالِحٍ، حَدَّثَنِي مُعَاوِيَةُ، بْنُ صَالِحٍ، عَنْ عَلِيِّ ابْنِ أَبِي طَلْحَةَ، عَنِ ابْنِ عَبَّاسٍ قَوْلَهُ: وَالزَّانِيَةُ لَا يَنْكِحُهَا إِلا زَانٍ أَوْ مُشْرِكٌ من غير أهل القبلة.
