[6448] Yunus ibn Habib narrated to us, Abu Dawud narrated to us, Shu'bah narrated to us, from Qays ibn Muslim, he said: From Tariq ibn Shihab, narrating from al-Haytham ibn al-'Uryan al-Nakha'i, he said: I saw 'Abd Allah ibn 'Amr near Mu'awiyah, and he was similar to the mawali (clients/freedmen). I asked him about the saying of Allah the Exalted: "But whoever gives [his right as] charity, then it is an expiation for him," and he said: It erases from his sins in proportion to what he gave as charity.
[6449] al-Hasan ibn Muhammad ibn Shaybah al-Wasiti narrated to us, Sufyan narrated to us, from 'Ata' ibn al-Sa'ib, from Sa'id ibn Jubayr, from Ibn 'Abbas, regarding his saying: "...then it is an expiation for him"—meaning for the one who inflicted the wound, while the reward of the wounded person is with Allah. It was narrated from Khaythamah ibn 'Abd al-Rahman, Mujahid, Ibrahim [in one of his two views], 'Amir al-Sha'bi, and Jabir ibn Zayd similarly.

My father narrated to us, Hammad ibn Zadhan narrated to us, Harami—meaning Ibn 'Umarah—narrated to us, Shu'bah narrated to us, from 'Umarah—meaning Ibn Abi Hafsah—from a man, from Jabir ibn 'Abd Allah, regarding the saying of Allah: "...then it is an expiation for him," he said: For the wounds. It was narrated from al-Hasan al-Basri, Ibrahim al-Nakha'i [in one of his two views], and Abu Ishaq al-Hamdani similarly.
His saying, the Exalted: "And whoever does not judge by what Allah has revealed"
[6450] My father narrated to us, Abu Salih narrated to me, Mu'awiyah ibn Salih narrated to me, from 'Ali ibn Abi Talhah, from Ibn 'Abbas, regarding his saying: "And whoever does not judge by what Allah has revealed"—he says: Whoever denies anything of the bounds (hudud) of Allah has committed disbelief, and whoever commands it but does not judge by it, he is an oppressor and a transgressor (fasiq).

[6451] Ahmad ibn Sinan al-Wasiti narrated to us, Abu Mu'awiyah al-A'mash narrated to us, from 'Abd Allah ibn Murrah, from al-Bara', regarding his saying: "...then it is those who are the wrongdoers"—he said: It was revealed regarding the Jews. It was narrated from Ibn 'Abbas, al-Sha'bi, al-Hasan, and Muqatil ibn Hayyan similarly.

[6452] Abu Sa'id al-Ashajj narrated to us, Abu Usamah narrated to us, from Sufyan, from Ibn Jurayj, from 'Ata', regarding his saying: "...then it is those who are the wrongdoers"—he said: Wrongdoing (zulm) below wrongdoing.

٦٤٤٨ - حَدَّثَنَا يُونُسُ بْنُ حَبِيبٍ ثنا أَبُو دَاوُدَ ثنا شُعْبَةُ عَنْ قَيْسِ بْنِ مُسْلِمٍ قَالَ: عَنْ طَارِقِ بْنِ شِهَابٍ يُحَدِّثُ عَنِ الْهَيْثَمِ بْنِ الْعُرْيَانِ النَّخَعِيِّ قَالَ: رَأَيْتُ عَبْدَ اللَّهِ بن عمرو عن معاوية أجمر شَبِيهًا «١» بِالْمَوَالِي فَسَأَلْتُهُ عَنْ قَوْلِ اللَّهِ تَعَالَى فَمَنْ تَصَدَّقَ بِهِ فَهُوَ كَفَّارَةٌ لَهُ قَالَ: يَهْدِمُ عَنْهُ مِنْ ذُنُوبِهِ بِقَدْرِ مَا تَصَدَّقَ بِهِ.
٦٤٤٩ - حَدَّثَنَا الْحَسَنُ بْنُ مُحَمَّدِ بْنِ شَيْبَةَ الْوَاسِطِيُّ حَدَّثَنَا سُفْيَانُ عَنْ عَطَاءِ بْنِ السَّائِبِ عَنْ سَعِيدِ بْنِ جُبَيْرٍ عَنِ ابْنِ عَبَّاسٍ قَوْلَهُ: فَمَنْ تَصَدَّقَ بِهِ فَهُوَ كَفَّارَةٌ لَهُ لِلْجَارِحِ وَأَجْرُ الْجَرِيحِ عَلَى اللَّهِ وَرُوِيَ عَنْ خَيْثَمَةَ بْنِ عَبْدِ الرَّحْمَنِ وَمُجَاهِدٍ وَإِبْرَاهِيمَ «٢» فِي أَحَدِ قَوْلَيْهِ وَعَامِرٍ الشَّعْبِيِّ وَجَابِرِ بْنِ زَيْدٍ نَحْوُ ذَلِكَ.
وَالْوَجْهُ الثَّانِي:
حَدَّثَنَا أَبِي ثنا حَمَّادُ بْنُ زَاذَانَ ثنا حَرَمِيٌّ يَعْنِي ابْنَ عُمَارَةَ ثنا شُعْبَةُ عَنْ عُمَارَةَ يَعْنِي ابْنَ أَبِي حَفْصَةَ عَنْ رَجُلٍ عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ فِي قَوْلِ اللَّهِ فَمَنْ تَصَدَّقَ بِهِ فَهُوَ كَفَّارَةٌ لَهُ قَالَ: لِلْجُرُوحِ. وَرُوِيَ عَنِ الْحَسَنِ الْبَصْرِيِّ وَإِبْرَاهِيمَ النَّخَعِيِّ فِي أَحَدِ قَوْلَيْهِ وَأَبِي إِسْحَاقَ الْهَمْدَانِيِّ نَحْوُ ذَلِكَ.
قَوْلُهُ تَعَالَى: وَمَنْ لَمْ يَحْكُمْ بِمَا أَنْزَلَ اللَّهُ
٦٤٥٠ - حَدَّثَنَا أَبِي ثنا أَبُو صَالِحٍ حَدَّثَنِي مُعَاوِيَةُ بْنُ صَالِحٍ عَنْ عَلِيِّ بْنِ أَبِي طَلْحَةَ عَنِ ابْنِ عَبَّاسٍ قَوْلَهُ: وَمَنْ لَمْ يَحْكُمْ بما أنزل الله يَقُولُ: مَنْ جَحَدَ شَيْئًا مِنْ حُدُودِ اللَّهِ فَقَدْ كَفَرَ، وَمَنْ أَمَرَ بِهَا وَلَمْ يَحْكُمْ بِهَا فَهُوَ ظَالِمٌ فَاسِقٌ.
قَوْلُهُ تَعَالَى: فَأُولَئِكَ هم الظالمون

٦٤٥١ - حَدَّثَنَا أَحْمَدُ بْنُ سِنَانٍ الْوَاسِطِيُّ ثنا أَبُو معاوية بن الأَعْمَشِ عَنْ عَبْدِ اللَّهِ بْنِ مُرَّةَ عَنْ الْبَرَاءِ قَوْلَهُ: فَأُولَئِكَ هُمُ الظَّالِمُونَ قَالَ: أُنْزِلَتْ فِي الْيَهُودِ. وَرُوِيَ عَنِ ابْنِ عَبَّاسٍ وَالشَّعْبِيِّ وَالْحَسَنِ وَمُقَاتِلِ بْنِ حَيَّانَ نَحْوُ ذَلِكَ.

٦٤٥٢ - حَدَّثَنَا أَبُو سَعِيدٍ الأَشَجُّ ثنا أَبُو أُسَامَةَ عَنْ سُفْيَانَ عَنِ ابْنِ جُرَيْجٍ عَنْ عَطَاءٍ قَوْلَهُ: فَأُولَئِكَ هُمُ الظَّالِمُونَ قال: ظُلْمٌ دون ظلم.
