difference of opinion(2), because the Prophet (may Allah bless him and grant him peace) said: "Do not drink from vessels of gold and silver, and do not eat from their bowls, for they are for them in this world and for you in the Hereafter." He forbade drinking from silver vessels and said: "Whoever drinks from them in this world shall not drink from them in the Hereafter." He (peace and blessings be upon him) also said: "He who drinks from silver vessels only makes the fire of Hell rumble in his belly." These are all agreed upon(4), and the prohibition(5) implies impermissibility. He mentioned a severe warning regarding this which necessitates prohibition. "Nar Jahannam" (the fire of Hell) is narrated with both the damma (nominative case) and the fatha (accusative case) on the r'; those who use the nominative attribute the action to the fire, while those who use the accusative imply the doer of the action within the verb and make the fire the object, its meaning being: the drinker makes the fire of Hell rumble in his belly. The reason for the prohibition of drinking from them is what it entails of pride, arrogance, and wounding the hearts of the poor, and this is present in using them for purification and in their usage in any manner; indeed, if it is prohibited in [situations] other than worship, it is more so [prohibited] in worship.

(2) In the margin of M: "The disagreement is established from Dawud, even in eating, and from Mu'awiyah ibn Qurrah, even in drinking. The hadith is specific to eating and drinking, so analogy of all usage to them is an analogy with a discrepancy (qiyas ma' al-fariq). As al-Shawkani investigated in Nayl al-Awtar, he said: 'The basis is permissibility, supported by original freedom from liability (bara'ah asliyyah), and it has been bolstered by the hadith: "But you are to use silver, so play with it as you wish." Narrated by Ahmad and Abu Dawud.'" (3) In M, there is an addition: "gold and". It is not present in the sources of extraction.
