the customary place; due to what we have mentioned. Section: A virgin woman is like a man, because her hymen prevents the urine from spreading. As for a deflowered woman, if the urine exits with force and does not spread, then it is the same. If it extends to the exit of menstruation, our companions said: It is obligatory to wash it, because the exit of menstruation and the child is not the exit of urine. It is possible that it is not obligatory, because this is customary in her case, so istijmār suffices for it, like the customary [practice] in others. Also, if washing were incumbent upon her, despite it being customary, the Prophet (may Allah bless him and grant him peace) would have clarified it to his wives, as it is something that needs to be known. If one doubts whether the discharge spread to what necessitates washing, it is not obligatory, because the original state is its absence, and washing is recommended as a precaution. Section: An uncircumcised man, if he is imperforate such that his skin does not emerge from his foreskin, he is like the circumcised. If it is possible for him to uncover it, he uncovers it, and when he urinates and performs istijmār, he returns it. If it becomes impure from the urine, it is incumbent upon him to wash it, just as if it had spread to the glans. Section: If the customary exit is blocked and another opens, istijmār does not suffice for it, because it is not the customary passage. It was narrated from some of our companions that it does suffice, because it has become customary. Our position is that this is rare in relation to the rest of people, so the rulings of the private part are not established for it; for touching it does not invalidate wudūʾ, and no hadd punishment, dowry, or ghusl is necessitated by penetration into it, nor any other such rulings, so it is like the rest of the body. Section: The apparent meaning of Aḥmad’s words is that the place of istijmār is pure after purification. Aḥmad ibn al-Ḥusayn said: I asked Abū ʿAbd Allāh about a man who urinates, seeks to clear himself, and performs istijmār, then sweats in his trousers? He said: If he performs istijmār three times, there is no harm. A man asked him, saying: If I perform istinjāʾ from excrement, does that water touch another place on me? Aḥmad said: It has been narrated regarding istinjāʾ that there are three stones, so you perform istinjāʾ with three stones, then do not worry about what touches you of
