in the case where she sees three [days] of black [blood] then it becomes red, for more than the three [days], and the matter is otherwise.

Section: If her menstruation was five days from the beginning of her month (22), then she experienced istihada, and began to see five (23) days of black [blood] then it becomes red and is continuous, the black is menstruation without disagreement, because it agrees with the time of the habit and the discrimination. If she sees red in place of the black, then it becomes black and exceeds [the maximum], the ruling of the black falls away due to it exceeding the maximum of menstruation, and her menstruation was the red, due to it agreeing with the time of the habit. And if she sees red in place of the habit, then five [days] of black, then it becomes red and is continuous, whoever gives precedence to the habit assigns as her menstruation the days of the habit. And when the black [blood] repeats, the Qadi said: It becomes menstruation. As for whoever gives precedence to the discrimination, he makes the black alone menstruation.

94 - Issue; He said: (If she has days she has forgotten, then she sits for six or seven in every month).

This is from the fourth category of the categories of the woman experiencing istihada, and she is the one who has no habit and no discrimination. This category has two types: One of them is the one who has forgotten, and she has three states: The first, that she is forgetful of her time and her number, and this is what the jurists call the "mutahayyira" (the confused woman). The second, that she forgets her number and remembers her time. The third, that she remembers her number and forgets her time.

As for the one who has forgotten both, she is the one whose ruling al-Khiraqi mentioned, and that she sits for six or seven days in every month; this is her menstruation, then she performs ghusl, and she is in what is after that experiencing istihada; she fasts, prays, and performs tawaf. According to Ahmad: She sits for the minimum menstruation, then if she knows her month, and it is different from the known month, she sits that [amount] from her month; and if she does not know her month, she sits from the known month, because it is the most common. Al-Shafi'i said regarding the one who has forgotten both: She has no menstruation with certainty, and her entire time is doubtful; she performs ghusl for every prayer, prays and fasts, and her husband does not come to her. He has another view, that she sits for the certain [amount]. Some of his companions said: The first is more correct; because this woman has known days, and it is impossible to return them to others, so her entire time is doubtful. Aisha has narrated that Umm Habiba experienced istihada for seven years, so she asked the Prophet (may Allah bless him and grant him peace), and he ordered her to perform ghusl, [and she used to perform ghusl] for every prayer. Agreed upon.
