Section: If the woman for whom the blood has continued is a possessor of discernment (mumayyiza), according to what we have mentioned previously, she shall sit [i.e., refrain from prayer and fasting] based on that discernment after the three months, and she sits during the three months for the duration of certainty, a day and a night, unless we say: A habit is established by two occurrences, in which case she returns to the discernment in the third month, and it is acted upon. Ibn 'Aqil said: There is [a narration] from Ahmad that she is referred to the discernment in the second month, and repetition is not considered. For he said: If menstruation begins for her, and the blood does not cease, and she does not know her days, she shall sit upon the arrival of the blood when its darkness, thickness, and odor arrive. Then, when it recedes, clarifies, and its odor departs, she performs prayer and fasting. That is because she is a mustahada who possesses discernment, so she is referred to her discernment, as in the fourth month, and repetition is not considered regarding discernment after one knows her state of istihada, according to what we have advocated. The Qadi said: She does not sit [based] on it except for what has been repeated. According to this, if she sees in every month five [days] red then five black, then red and it becomes continuous, she sits during the time of the black [blood], so it is her menstruation, and the rest is istihada. Does she sit [during] the time of the black [blood] in the second, third, or fourth month? This is derived from the three narrations. If she saw ten [days] red, then five black, then red and it became continuous, the ruling for her is the same as the one before her. If the black [blood] is continuous and exceeds the maximum duration of menstruation, then she has no discernment, and we assign her menstruation based on the black [blood] because it is more similar to menstrual blood. If she saw less than a day of black blood, she has no discernment, because the black [blood] is not fit to be menstruation due to its being less than the minimum duration of menstruation. If she saw in the first month all red, and in the second, third, and fourth five black, then red and continuous, and in the fifth all red, then she sits in the three months [for] the duration of certainty, and in the fourth [she sits for] the days of the black blood, and in the fifth, she also sits for five [days] because she has become a person with a habit. The Qadi said: She does not sit from the fourth [month] except for the [duration of] certainty, unless we say that a habit is established by two occurrences. This is open to consideration, for the most that can be estimated for her is that she has no habit and no discernment; and if she were such, she would sit for six or seven [days], according to the soundest narration; so it is the same here. And whoever does not consider repetition in discernment, this [woman] is a possessor of discernment, and whoever says that the possessor of discernment sits [based] on the discernment...
