in the Abode of War (Dar al-Harb), so his need calls him to intercourse, so he engages in it and practices 'azl. Al-Khiraqi mentioned this scenario. Or his wife might be a slave-woman, and he fears enslavement for his child, or he owns a slave-woman and has a need to have intercourse with her while also needing to sell her; and it has been narrated from Ali, may Allah be pleased with him, that he used to practice 'azl with his slave-women. If he practices it without a need, it is makruh, but not forbidden. The concession (rukhsah) regarding it was narrated from Ali, Sa'd ibn Abi Waqqas, Abu Ayyub, Zayd ibn Thabit, Jabir, Ibn 'Abbas, al-Hasan ibn Ali, Khabbab ibn al-Aratt, Sa'id ibn al-Musayyib, Tawus, 'Ata', al-Nakha'i, Malik, al-Shafi'i, and the Scholars of Opinion (Ashab al-Ra'y). Abu Sa'id narrated that he said: 'Azl was mentioned in the presence of the Messenger of Allah (peace and blessings of Allah be upon him), and he said: "Why does one of you do that?" And he did not say: "Let not one of you do that." [He added:] "For there is no soul destined to be created but that Allah is its Creator." Agreed upon. From him, that a man said: "O Messenger of Allah, I have a slave-woman and I practice 'azl with her, and I dislike that she becomes pregnant, and I want what men want, but the Jews say that 'azl is the 'minor infanticide' (al-maw'udah al-sughra)." He said: "The Jews have lied; if Allah willed to create it, you would not be able to prevent it." Narrated by Abu Dawud.
