I have allocated seven [days] for you, and if I allocate seven for you, I will allocate seven for my wives." Narrated by Muslim. In another wording: "And if you wish, I will assign three, then I will rotate." In another wording: "And if you wish, I will increase it for you, then I will compensate you for it; for the virgin there is seven, and for the thayyib there is three." In another wording narrated by al-Daraqutni: "If you wish, I will stay with you for three days exclusively for you, and if you wish, I will assign seven to you, then I will assign seven to my wives." This refutes their analogy and takes precedence over it. Ibn 'Abd al-Barr said: "The elevated (marfu') hadiths in this chapter are according to what we have stated, and those who disagree with us have no elevated hadith, and the argument lies with those who bring forth the Sunnah."

Section: The slave woman and the free woman are equal in this. The followers of al-Shafi'i have three views on this: one is like our opinion. The second is that the slave woman is entitled to half of what the free woman gets, as in the rest of the division. The third is that the virgin among slave women gets four [days], and the thayyib gets two nights, to complete the part of the night. Our evidence is the generality of his saying, peace and blessings of Allah be upon him: "For the virgin there is seven, and for the thayyib there is three." Moreover, it is intended for companionship and the removal of reserve, and the slave woman and the free woman are equal in their need for it, so they are equal in it, like maintenance.
