Because he is unable to fulfill the rights of both of them, and the one whose right he does not fulfill will be harmed and feel lonely. If he does so, and one of them is brought in before the other, he should begin with her and fulfill her right, then return and fulfill the right of the second, then commence the division. If the second is brought in during the duration of the right of the contract, he should complete it for the first, then make up the right of the second. If they are both brought in to him in one place, he should cast lots between them, and present the one for whom the lot was drawn, then fulfill [the right of] the other after her.
Section: If he has two wives, and he spends a night with one of them, then marries a third before the night of the second, he should prioritize the newlywed with her nights, because her right is more confirmed; for it was established by the contract, whereas the right of the second was established by his action. Once he has fulfilled the right of the new wife, he begins with the second and fulfills her night, then spends the night with the new wife, then commences the division. The Qadi mentioned that if he fulfills the second's night, he should spend half a night with the new wife, then commence the division; because the night he fulfills for the second, half of it is her right and half of it is the right of the other. Thus, a half-night is established for the new wife in exchange for what accrued to each of her co-wives. According to this view, he would need to be alone with himself for half a night, which involves hardship; for he may not find a place to be alone, or be unable to go out to it in the middle of the night, or return from it. What we have mentioned regarding beginning with her after the second fulfills her right without this hardship, so it is more appropriate, God willing.
Section: The ruling of the seven [days] and the three [days] that he stays with the newlywed is the ruling of the rest of the division, in that its basis is the night, and he has the right to go out during the day for his livelihood and to fulfill the rights of people. If it becomes impossible for him to stay with her at night—due to work, confinement, or if he leaves that for a reason other than an excuse—he shall make it up for her, and he has the right to go out
