the Almighty saying: {Save yourselves and your families from a Fire} [16]. He said: Teach them, discipline them [17]. Abu Muhammad al-Khallal narrated with his chain of authority from Jabir, who said: The Messenger of God (may God bless him and grant him peace) said: "May God have mercy on a person [18] who hangs a whip in his house to discipline his family" [19]. If she does not pray, Ahmad said: I fear that it is not permissible [for a man to] [20] remain with a woman who does not pray, does not perform the ritual bath (ghusl) from sexual impurity, and does not learn the Quran. Ahmad said regarding a man who strikes his wife: It is not appropriate for anyone, not even her father, to ask him: Why did you strike her? [21] The basis for this is what al-Ash'ath narrated from Umar, that he said: O Ash'ath, memorize from me something I heard from the Messenger of God (may God bless him and grant him peace): "Do not ask a man why he struck his wife." Narrated by Abu Dawud [22]. This is because he may strike her due to marital intimacy; if he were to disclose that, he would be ashamed, and if he were to disclose something else, he would be lying.
Section: If a woman fears the recalcitrance (nushuz) of her husband and his turning away from her due to his lack of desire for her—whether due to an illness she has, old age, or ugliness—there is no harm if she waives some of her rights in order to satisfy him by that, due to the saying of God Almighty: {And if a woman fears from her husband recalcitrance or turning away, there is no sin upon them if they make [23] a settlement between them} [24]. Al-Bukhari [25] narrated from Aisha: {And if a woman fears from her husband recalcitrance or turning away, there is no sin upon them if they make a settlement} [23]
