مجلد 10 · صفحة 419١٢٧١ - مسألة؛ قال: (وإذا قال لها: إذا طلقتك فأنت طالق. فإذا طلقها لزمه اثنتان، إذا كانت مدخولا بها، وإن كانت غير مدخول بها، لزمته واحدة)

divorce. If he says: "You are divorced one month before my death," and one of them dies before the passing of a month, no divorce occurs; because divorce does not occur in the past. If he dies one month and a moment after establishing the oath, we determine that the divorce occurred at that moment, and they do not inherit from one another, unless the divorce is revocable and he dies during her 'iddah. If he says: "You are divorced before my death," and adds nothing, she is divorced immediately; because the time before his death from the moment of establishing the description is a valid venue for divorce, so it occurs at its beginning. If he says: "Before your death or Zayd's death," the ruling is the same. If he says: "You are divorced before Zayd's arrival" or "before you enter the house," the Qadi stated: She is divorced immediately, whether Zayd arrives or does not arrive; based on the evidence of the words of Allah Almighty: "O you who were given the Scripture, believe in what We have sent down, confirming that which is with you, before We obliterate faces and turn them towards their backs" (4:47). Yet, the obliteration did not occur among those commanded. If he were to say to his slave: "Give me to drink before I strike you," and he gives him to drink immediately, he is considered to have complied even if he does not strike him. If he says: "You are divorced shortly before my death" or "shortly before Zayd's arrival," it does not occur immediately, but rather it occurs in the portion of time that immediately follows the death; because this is a diminutive form that necessitates the slight portion that remains. If he says: "You are divorced one month before the death of Zayd and 'Amr," the Qadi stated: The description attaches to the one who dies first; because giving consideration to the second [death] would lead to its occurrence after the death of the first, [whereas giving consideration to the first] does not lead to that, so it is more appropriate.

1271- Issue: He said: (And if he says to her: "When I divorce you, you are divorced." Then when he divorces her, two [divorces] become binding upon him if she has been consummated with, and if she has not been consummated with, one becomes binding upon him).

طلاقٌ. فإن قال: أنتِ طالقٌ قبلَ مَوْتِى بشهرٍ. فمات أحدُهما قبلَ مُضِىِّ شهرٍ، لم يَقعْ طلاقٌ؛ لأنَّ الطَّلاقَ لا يَقَعُ فى الماضى. وإن ماتَ بعدَ عَقْدِ اليمينِ بشهرٍ وساعةٍ، تَبَيَّنَّا وقُوعَ الطَّلاقِ فى تلك السَّاعةِ، ولم يَتَوَارَثا، إلَّا أن يكونَ الطَّلاقُ رَجْعِيًّا، ويموتَ فى عِدَّتِها. وإن قال: أنتِ طالقٌ قبل موتى. ولم يَزِدْ شيئًا، طَلُقَتْ فى الحالِ؛ لأنَّ ما قبلَ موتِه من حينِ عَقْدِ الصِّفَةِ مَحَلٌّ للطّلاقِ، فوقعَ فى أولِه. وإن قال: قبلَ موتِك أو موتِ زيد. فكذلك. وإن قال: أنتِ طالقٌ قبلَ قُدومِ زيد، أو قبلَ دخولكِ الدَّارَ. فقال القاضى: تَطْلُقُ فى الحالِ، سَواءٌ قَدِمَ زيذ أو لم يَقْدَمْ؛ بدليلِ قولِ اللَّهِ تعالى: {يَاأَيُّهَا الَّذِينَ أُوتُوا الْكِتَابَ آمِنُوا بِمَا نَزَّلْنَا مُصَدِّقًا لِمَا مَعَكُمْ مِنْ قَبْلِ أَنْ نَطْمِسَ وُجُوهًا فَنَرُدَّهَا عَلَى أَدْبَارِهَا} (٢٧). ولم يُوجَدِ الطَّمس فى المأْمورِينَ. ولو قال لغلامِه: اسْقِنى قبلَ أن أضْربَك. فسَقاه فى الحالِ، عُدَّ مُمْتَثِلًا وإن لم يَضربه. ولو (٢٨) قال: أنت طالقٌ قُبَيْلَ مَوْتِى، أو قُبَيلَ قُدومِ زيد. لم يَقَعْ فى الحالِ، وإنَّما يَقعُ ذلك فى الجزءِ الذى يَلِى الموتَ؛ لأنَّ ذلك تصغير يَقْتَضِى الجزءَ اليسيرَ (٢٩) الذى يَبْقَى. وإن قال: أنتِ طالقٌ قبلَ موتِ زيدٍ وعمرٍو بشهر. فقال القاضى: تتعلَّق الصِّفَةُ بأوّلِهما مَوْتًا؛ لأنَّ اعتبارَه بالثَّانى يُفْضِى إلى وُقوعِه بعدَ مَوْتِ الأوَّلِ، [واعْتبارُه بالأوَّلِ] (٣٠) لا (٣١) يُفْضِى إلى ذلك، فكان أوْلَى.

١٢٧١ - مسألة؛ قال: (وَإِذَا قَالَ لَهَا: إِذَا طَلَّقْتُكِ فَأَنْتِ طَالِقٌ. فإِذَا طَلَّقَهَا لَزِمَهُ اثْنَتَانِ، إِذَا كَانتْ مَدْخُولًا بِهَا، وَإِنْ كَانَتْ غَيْرَ مَدْخُولٍ بِهَا، لَزِمَتْهُ وَاحِدَةٌ)
