the families" (7). And 'Umar said: "She is entitled to the 'uqr (bridal payment/compensation) of the women of her family." And Muhalhil said:
She was given in marriage by her family to the Arāqim (tribe) in a conflict, and the dower was [paid in] hides. If he had come to propose to her with the two Abān mountains, the face of the suitor would have been stained with blood.
It is said: "aṣdaqtu al-mar'ah" (I gave the woman a dowry) and "mahartuhā". One does not say: "amhartuhā".
Section: It is recommended that the marriage [contract] not be devoid of naming a dowry, because the Prophet (peace and blessings of Allah be upon him) used to marry off his daughters and others, and he himself would marry (10), and he would never leave that [marriage] without a dowry. He said to the man to whom he married off the woman who had gifted herself [to him]: "Do you have anything you can give her as a dowry? (11)" He searched but found nothing (12). He said: "Search, even for an iron ring." He still could not find anything, so he married him to her for what he possessed of the Qur'an (13). Also, because it is more conclusive in preventing disputes and disagreements regarding it, though specifying it is not a condition; as evidenced by His saying, the Exalted: "There is no blame upon you if you divorce women while you have not yet touched them nor specified for them an obligation (dowry)" (Al-Baqarah: 236). It is also narrated that the Messenger of Allah (peace and blessings of Allah be upon him) married a man to a woman without specifying a dowry for her (15).
