The half is taken for the half, and the quarter for the quarter, and what exceeds or is less is calculated accordingly, based on what we mentioned regarding the nose and the ear.
1447 - Issue: He said: (And the two testicles for the two testicles).
Retaliation is carried out regarding the two testicles; due to the scriptural evidence (nass) and legal logic (ma'na) we have mentioned. We know of no disagreement regarding this. If he cuts off one of them, and the experts say that it is possible to take it while keeping the other safe, it is permitted. If they say: The safety of the other is not guaranteed, it shall not be taken, for fear of injustice (hayf), and it shall be subject to half the blood money (diyah). If the safety of the other is guaranteed, the right is taken for the right, and the left for the left, due to what we have mentioned regarding other than them.
Section: There are two views regarding retaliation for the labia (shafrayn) of a woman; one of them is that there is no retaliation for them; because it is flesh that has no joint to which it terminates, so retaliation is not mandatory for it, like the flesh of the thighs. This is the statement of the Qadi. The second is that there is retaliation for them; because their termination point is known, so they resemble the lips and the eyelids. This is the statement of Abu al-Khattab. The Shafi'i scholars have two views, like these two.
Section: If he cuts off the member of a hermaphrodite (khuntha mushkil), or his two testicles, or his labia, and he opts for retaliation, there is no immediate retaliation, and the matter is paused until his condition becomes clear; because we do not know if the severed part is an original organ. If he opts for the blood money, and his condition is expected to be clarified, we grant him the certainty, so he receives a discretionary compensation (hukumah) for the severed part. If he has severed all of them, he is entitled to the blood money of a woman for the labia, and a discretionary compensation for the member and the two testicles. If there is despair of his condition being clarified, he is given half the blood money for the member and the two testicles, and half the blood money for the labia, and a discretionary compensation for half of all that.

النَّصْفُ بالنِّصْفِ، والرُّبعُ بالرُّبعِ، وما زاد أو نَقَصَ فبحسابِ (٧) ذلك، على ما ذكَرْناه في الأَنْفِ والأذُنِ.
١٤٤٧ - مسألة؛ قال: (والأُنْثَيَانِ بِالْأُنْثَيَيْنِ)
ويَجرِى القِصاصُ في الأُنْثَيَيْنِ؛ لما ذكرْنا من النَّصِّ والمعنى. ولا (١) نعلمُ فيه خلافًا، فإن قَطَعَ إحداهُما، وقال أهلُ الخِبْرةِ، إنَّه مُمْكِنٌ أخْذُها مع سلامةِ الأُخْرَى. جاز. فإن قالوا: لا يُؤْمَنُ تَلَفُ الأُخْرَى. لم تُؤْخَذْ خَشْيةَ الحَيْفِ، ويكون فيها نِصْفُ الدِّيَةِ. وإن أُمِنَ تَلَفُ الأُخْرَى، أُخِذَتِ اليُمْنَى باليُمْنَى، واليُسْرَى باليُسْرَى؛ لما ذكرْناه في غيرِهما.
فصل: وفى القِصاصِ في شَفْرَىِ المرأةِ وَجْهان؛ أحدهما (٢)، لا قِصاصَ فيهما؛ لأنَّه لَحْمٌ لا مَفْصِلَ له يَنْتَهِى إليه، فلم يَجِبْ فيه قِصاصٌ، كلَحْمِ الفَخِذَيْنِ. هذا قولُ القاضِى. والثاني، فيهما القِصاصُ؛ لأنَّ انْتهاءَهُما معروفٌ، فأشْبَها الشَّفَتَيْنِ وجَفْنَىِ العَيْنَيْن (٣). وهذا قولُ أبى الخَطَّابِ. ولأصحابِ الشافعىِّ وَجْهان، كهذَيْن.
فصل: إن قَطَعَ ذكَرَ خُنْثَى مُشْكِلٍ، أو أُنْثَيَيْه، أو شَفْرَيْه، فاختارَ القِصاصَ، لم يكُنْ له قِصاصٌ في الحالِ، ويَقِفُ الأمرُ حتى يتَبَيَّنَ حالُه؛ لأنَّنا لا نعلمُ أنَّ المَقْطُوعَ عُضْوٌ أصْلِىٌّ. وإن اختارَ الدِّيَةَ، وكان يُرْجَى انْكِشافُ حالِه، أعْطَيْناه اليَقِينَ، فيكونُ له حكومةٌ في المَقْطُوعِ. وإن كان قد قَطَعَ جَمِيعَها، فله دِيةُ امرأةٍ في الشَّفْرَيْنِ، وحُكومةٌ في الذَّكَرِ والأُنْثَيَينِ. وإن يُئِسَ من انْكشافِ حالِه، أُعْطِىَ نِصْفَ دِيَةِ الذَّكَرِ والأُنْثَيَيْنِ، ونِصْفَ دِيَةِ الشَّفْرَيْنِ، وحُكومةً في نِصْفِ ذلك كلِّه.
