the body, through which beauty is achieved, and there are no other limbs of their type in the body, so the blood money is due for them, like the hands. Also, because he has removed the beauty [completely] (5), the blood money is due, like the four types of hair according to Abu Hanifa, and like the ears of a deaf person and the nose of one who has lost the sense of smell according to everyone. It differs from the blind eye, because there is no complete beauty in it, and because it is an organ from which the part for which blood money is due has been lost, so its blood money was not completed, unlike the two hands if they are paralyzed, which is different from our issue.
1494 - Issue; he said: (And in the two buttocks, the blood money is due.)
Ibn al-Mundhir said: All those of the people of knowledge from whom we have memorized say: The blood money is due for the two buttocks, and for each of them half of it. Among them are 'Amr ibn Shu'ayb, al-Nakha'i, al-Shafi'i, and the People of Opinion (Ashab al-Ra'y). This is because they are two limbs of the same kind, in which there is manifest beauty and complete benefit, for one sits upon them just like cushions; thus, the blood money is due for them, and half for one of them, just like the two hands. The buttocks are what rise and protrude [above the back and from] (2) the level of the thighs. The blood money is due in them if they are taken down to the bone beneath them, and for the loss of some of them, a proportional amount is due; because whatever the blood money is due for, a proportional amount of it is due for a part of it. If the amount is unknown, a judicial assessment (hukuma) is due, because it is a deficiency the extent of which is not known.
Section: In the spine (sulb), the blood money is due if it is fractured and does not heal; because of what was narrated in the letter of the Prophet, may Allah bless him and grant him peace, to 'Amr ibn Hazm: "And in the spine, the blood money is due" (4). It is narrated from Sa'id ibn al-Musayyab that he said: The Sunnah has passed that the blood money is due in the spine. This refers to the Sunnah of the Prophet, may Allah bless him and grant him peace. Among those who held this view were Zayd ibn Thabit,

البَدَنِ، يحْصُلُ بهما الجمالُ، ليس في البدنِ غيرُهما من جِنْسِهما، فوجَبتْ فيهما الدِّيَةُ كاليَدَيْن، ولأنَّه أذْهبَ الجمالَ [على الكمال] (٥)، فوجبَتِ الدِّيَةُ، كالشُّعورِ الأرْبعةِ عندَ أبى حنيفةَ، وكأذُنَىِ الأصَمِّ وأنْفِ الأخْشَمِ عندَ الجميع، ويُفارِقُ العَيْنَ القائمةَ؛ لأنَّه ليس فيها جَمالٌ كاملٌ، ولأنَّها عُضْوٌ قد ذهَب منه ما تجبُ فيه الدِّيَةُ، فلم تكْمُلْ دِيَتُه، كاليَدَيْنِ إذا شَلَّتا، بخلافِ مَسْألتِنا.
١٤٩٤ - مسألة؛ قال: (وَفِى الْأَلْيَتَيْنِ الدِّيَةُ)
قال ابنُ المُنْذِرِ: كلُّ مَن نَحْفَظُ عنه من أهلِ العلم يقولون: في الْأَلَيَتَيْنِ الدِّيَةُ، وَفِى كلِّ واحِدَةٍ منهما نصفُها. منهم عمرو بن شُعَيْب، والنَّخَعِىُّ، والشَّافعىُّ، وأصْحابُ الرَّأْىِ. ولأنَّهما عُضْوان من جِنْسٍ، فيهما جَمالٌ ظاهرٌ، ومَنْفَعةٌ كاملةٌ، فإنَّه يُجلَسُ عليهما كالوِسادَتَيْنِ، فوجَبَتْ (١) فيهما الدِّيَةُ، وفى إحداهما نصفُها، كاليَدَيْنِ. والأَلْيَتانِ. هما ما عَلَا وأشْرَفَ [عن الظَّهْر وعن] (٢) اسْتِوَاءِ الفَخِذَيْنِ. وفيهما الدِّيَةُ إذا أُخِذَتا إلى العَظْمِ الذي تحتهما، وفى ذهابِ بَعْضِهما بقَدْرِه؛ لأنَّ ما وجبَتِ (٣) الدِّيَةُ فيه، وجَبَ في بعضِه بقَدْرِه، فإن جُهِلَ المِقْدارُ، وَجَبَتْ حُكومةٌ؛ لأنَّه نَقْصٌ لم يُعْرَفْ قَدْرُه.
فصل: وفى الصُّلبِ الدِّيَةُ إذا كُسِرَ فلم ينْجَبِرْ؛ لما رُوِىَ في كتابِ النَّبِيِّ -صلى اللَّه عليه وسلم- لعمرو بنِ حَزْم: "وَفِى الصُّلْبِ الدِّيَةُ" (٤). وعن سعيد بن المُسَيَّب، أنَّه قال: مضت السُّنَّةُ أنَّ في الصُّلْبِ الدِّيَةَ. وهذا ينْصرِفُ إلى سُنَّةِ النَّبِيِّ -صلى اللَّه عليه وسلم-. وممَّن قال بذلك زيدُ بن ثابتٍ،
