castrated man, and the despair of ejaculation is realized in the penis of the castrated man, unlike the penis of the impotent man. Thus, according to our position that the blood money is not completed for the penis of the castrated man: if he severs the penis and the testicles at one time, or severs the penis and then severs the testicles, two blood monies are incumbent upon him. If he severs the testicles and then severs the penis, only one blood money is incumbent upon him for the testicles, and for the penis there is a government (hukuma - discretionary compensation); because it is the penis of a castrated man. The Qadi said: Ahmad has explicitly stated this. If he severs half of the penis length-wise, half of the blood money is due for it. Our companions have mentioned this. The more appropriate view is that the full blood money is due; because he has taken away the benefit of sexual intercourse (3) through it, so its blood money is completed, just as if he had paralyzed it or broken its spine and its sexual intercourse was lost. If he cuts a piece from it below the glans, and the urine continues to exit as it was before, then a portion of the blood money equivalent to that piece relative to the entire penis is due. If the urine exits from the site of the cut, then the greater of either the portion of the blood money for that piece or the government (hukuma) is due. If he punctures his penis below the glans, and the urine becomes exiting from that hole, then a government is due for it.
1496 - Issue: He said: (And for the two testicles is the blood money).
We know of no disagreement regarding this. In the letter of the Prophet (peace and blessings of Allah be upon him) to ‘Amr ibn Hazm: "And for the two testicles is the blood money" (1). Also, because they possess beauty and benefit, for lineage occurs through them, so the blood money is due for them, like the two hands. Al-Zuhri narrated from Sa‘id ibn al-Musayyib that he said: The Sunnah has passed that the blood money for the spine is the blood money, and for the two testicles is the blood money. For one of them, half the blood money is due, according to the opinion of most of the people of knowledge. It is narrated from Sa‘id ibn al-Musayyib that for the left one is two-thirds of the blood money, and for the right one is one-third of it; because the benefit (2) of the left one is greater; because the lineage is through it. Our view is that whatever two-part entity for which the blood money is due, half of it is due for one of them, like the two hands and all other organs. Furthermore, they are a pair for which the blood money is due, so their blood money is equal, like the fingers, and what they have mentioned is invalidated by the fingers and the eyelids,
