because he does not claim anything more than that, and the remainder is paid to the Public Treasury (Bayt al-Mal), because there is no one who is entitled to it. If there is a minor or an insane person among the heirs, his share is handed over to him, as well as the share of the one who confessed the apostasy of the inheritor, because his apostasy was not established with respect to him.

Section: As for one who is coerced into uttering the word of disbelief, it is more virtuous for him to show patience and not say it, even if that leads to his death, due to what Khabbab narrated from the Messenger of Allah (peace and blessings of Allah be upon him), who said: "A man among those before you would be taken, a pit would be dug for him in the earth, and he would be placed in it. Then a saw would be brought and placed upon the side of his head, and he would be sawed into two, yet that would not turn him away from his religion. And he would be combed with iron combs [to remove] the flesh from his bones, and that would not turn him away from his religion" (28). It came in the interpretation of the words of Allah the Exalted: "Cursed were the companions of the trench (4) - [containing] the fire full of fuel (5) - When they were sitting near it (6) - And they were witnesses to what they did to the believers" (29), that some kings of the disbelievers seized a group of believers, dug a trench for them in the earth, and ignited a fire in it. Then he said: "Whoever does not recant his religion, throw him into the fire." They began throwing them into it, until a woman came with a child on her shoulder (30), and she hesitated because of the child. The child said: "O mother, be patient, for you are upon the truth." Thus Allah the Exalted mentioned them in His Book (31). Al-Athram narrated from Abu Abd Allah [Ahmad bin Hanbal] that he was asked about a man who is taken prisoner and is presented with disbelief and coerced into it: is it permissible for him to apostatize? He disliked it severely and said: "This does not resemble (32) those among the Companions of the Prophet (peace and blessings of Allah be upon him) in my view, about whom the verse was revealed; those were merely asked for the word, and then they were left to do as they pleased."
