due to the convergence of sanctities, for those who hold the view of increasing the blood money of Muslims, [as the increase in the blood money of Muslims]. Harb said: I asked Abu Abd Allah: "If a Dhimmi is killed in the Sacred Precinct?" He said: "It is also increased beyond its amount, just as it is increased for a Muslim." al-Athram said: It was said to Abu Abd Allah: "If a crime was committed against a Magian regarding his eye or his hand?" He said: "It shall be calculated according to his blood money, just as the Muslim is treated by calculation, so too is this." It was said: "If he severed his hand?" He said: "[It is] half of his blood money."
1470 - Issue; He said: (If they are killed intentionally, the blood money is doubled for their Muslim killer; to compensate for the removal of retaliation.)
Thus did Uthman ibn Affan, may Allah be pleased with him, rule. This is narrated from Uthman, recorded by Ahmad, from Abd al-Razzaq, from Ma'mar, from al-Zuhri, from Salim, from his father, that a man killed a man from among the People of the Covenant (Dhimmah), so the case was referred to Uthman; he did not execute him, but increased the penalty for him by one thousand dinars. Ahmad adopted this following him. It has parallels in his school; for he mandated full blood money for the one-eyed man when he gouged out the eye of a healthy man, when he prevented retaliation against him, and he mandated double its value for the thief of dates, when he prevented the [punishment of] cutting [his hand] for him. This is the ruling of the Prophet (peace and blessings of Allah be upon him) regarding the thief of dates. Thus, a similar rule is established here. If the killer were a Dhimmi, or a Dhimmi killed a Muslim, the blood money would not be doubled for him, because retaliation is mandatory upon him in both cases. The majority of scholars hold that the blood money of a Dhimmi is not doubled in cases of intentional killing due to the generality of the traditions regarding it, and because it is mandatory blood money that is not doubled, like the blood money of a Muslim, or as if the killer were a Dhimmi. There is no difference in blood money between a Dhimmi and a Musta'man (one granted security), because each of them is a Person of the Book whose blood is inviolable. As for
