[There is also] the hadith of Buraydah (25) and 'Abd al-Rahman ibn 'Awf, and the statement of the Prophet (peace be upon him): 'Apply to them the tradition of the People of the Scripture.' There is no difference between them being non-Arabs (Ajam) or Arabs. This is the view of Malik, al-Awza'i, al-Shafi'i, Abu Thawr, and Ibn al-Mundhir. Abu Yusuf said: 'The jizya is not taken from the Arabs because they are honored by being from the tribe of the Prophet (peace be upon him).' Our argument is the generality of the verse and that the Prophet (peace be upon him) sent Khalid ibn al-Walid to Dumat al-Jandal (26), where he captured Ukaydir of Duma and made a peace treaty with him on the basis of the jizya, and he was an Arab. This was narrated by Abu Dawud (27). He also took the jizya from the Christians of Najran, and they were Arabs (28).
