the beginning of the year of his people, it is taken from him at its end along with them. If it is in the middle of the year, it is taken from him at the completion of the year in proportion to it, and he is not left until his [own specific] year is completed, so that there is no need to isolate him with a year [of his own] and track the year of every person among them, which might lead to having a separate year for each individual (9).
Section: As for the one who suffers from periodic insanity and recovery, he has three states. The first is that his insanity is not patterned, such as one who recovers for an hour of days or a day, or is struck by it for an hour of days or a day. His state is judged by the majority [of his time], because it is impossible to observe the period of recovery due to the difficulty of monitoring it. The second is that it is patterned, such as one who is insane for a day and recovers for two days, or less than that, or more, provided it is patterned. There are two positions regarding this. The first is that the majority of his state is considered, which is the school of Abu Hanifa, may Allah be pleased with him, because he is insane and recovers, so the majority of his state is considered, just like the first [state]. The second is that his days of recovery are aggregated (talaffuq), because if he were recovering for the whole time, Jizya would be mandatory. Thus, if recovery is found in some of the year, it becomes mandatory in what it would be mandatory for if it were isolated. Based on this position, there are two views on collecting the Jizya: the first is that his days are aggregated, so when they complete a year, it is collected from him, because collecting it before that would be collecting his Jizya before the completion of the year, which is not permissible, just like the sound person. The second is that it is collected from him at the end of every year in proportion to what he recovered, just as if he had recovered in part of the year with a continuous recovery. If he is insane for a third of the year and recovers for two-thirds, or vice versa, there are the two aforementioned views. If his recovery and insanity are equal, such as one who is insane for a day and recovers for a day, or is insane for half the year and recovers for half of it by habit, his recovery is aggregated because it is impossible to consider the majority due to its absence, so the other possibility is determined. The third state is that he is insane for half a year, then recovers with a continuous recovery, or recovers for half of it, then remains in continuous insanity, so there is no Jizya upon him in the latter case, and upon him in the former is the portion of Jizya corresponding to what he recovered of the year, according to what has been previously explained.
