Section: Concerning eating from crops, there are two narrations from Ahmad. One of them, he said: He may not eat [from them], for the concession was only for fruits, not crops. He said: We have not heard regarding crops that anything may be touched. Its reasoning is that Allah the Exalted created fruits to be eaten while fresh, and souls desire them (18), whereas crops are the opposite. The second [narration] is that he said: He may eat from the green grain (al-farik); because the custom is to eat it while fresh, it resembles fruit. The same ruling applies to fava beans, chickpeas, and the like, of what is eaten while fresh. As for barley, and what is not customarily eaten, it is not permissible to eat from it. The best course in fruits and other items is that one should not eat from them except with permission, due to the disagreement regarding it (19) and the reports that indicate prohibition.

Section: Concerning the milking of livestock, there are two narrations from Ahmad. One of them is that it is permissible for him to milk and drink, but he may not carry any away; because of what al-Hasan narrated from Samurah, that the Prophet (may Allah bless him and grant him peace) said: "If one of you comes upon livestock, and its owner is present, let him ask his permission; if he gives permission, let him milk and drink. If he is not present, let him call out three times; if someone answers him, let him ask permission, and if no one answers him, let him milk and drink, but do not carry any away." It was narrated by al-Tirmidhi (20), who said: "This is a hasan sahih hadith," and the practice of some of the people of knowledge is in accordance with it. This is also the position of Ahmad and Ishaq. The second narration is that it is not permissible for him to milk or drink, because of what Ibn 'Umar narrated, that the Messenger of Allah (may Allah bless him and grant him peace) said: "No one shall milk the livestock of another except with his permission. Would any of you like it if his storage place were come upon, his chest broken, and his food carried away (21)? For the udders of their livestock only store their food for them, so no one shall milk the livestock of another except with his permission." In another wording: "For what is in the udders of their livestock is like what is in their storage places." It is agreed upon (23).
