Yahya, Ishaq, Abu Khaythama, Ibn Abi Shaybah (1), Sulayman ibn Dawud (2), and the companions of [the school of] ra'y (opinion). The companions of Malik said: Saying "Amin" is not sunnah (3) for the imam, due to what Malik (4) narrated from Sumayy, from Abu Salih, from Abu Hurayrah, that the Messenger of Allah (peace be upon him) said: "When the imam says {not of those who have earned [Your] anger nor of those who have gone astray}, then say: Amin, for whoever his saying coincides with the saying of the angels, he will be forgiven (5)." This is evidence that he does not say it. Our argument is what was narrated by Abu Hurayrah, who said: The Messenger of Allah (peace be upon him) said: "When the imam says Amin, then say Amin, for whoever his saying of Amin coincides with the saying of the angels, he will be forgiven." It is agreed upon (6). Wa'il ibn Hujr also narrated that when the Prophet (peace be upon him) said: "wala-ddallin", he said: "Amin", and he raised his voice with it. It was narrated by Abu Dawud (7), and narrated by al-Tirmidhi (8), who said: And he extended his voice with it. He also said: It is (9) a hasan (good) hadith.
