And because it is an isolated prostration, the takbir is legislated at its commencement and upon rising from it, like the prostration of forgetfulness (sajdat al-sahw) after the salutation. It has [been established that the Prophet - peace and blessings of Allah be upon him - pronounced the takbir] (6) in it for the prostration and for rising. Al-Khiraqi did not mention the takbir for rising, but others among our companions have mentioned it, and it is the analogy (qiyas), [as we have mentioned] (7). It is not legislated to pronounce more than one takbir (8) at the commencement of the prostration. Al-Shafi'i said: If he prostrates outside of prayer, he pronounces one takbir for the opening and another for the prostration; because it is a prayer, so he pronounces a takbir for the opening distinct from the takbir of the prostration, just as if he were to pray two rak'ahs. Our evidence is the hadith of Ibn Umar (9), the apparent meaning of which is that he pronounced one takbir. Furthermore, the knowledge of this is established by the Law (Shari'ah) and the Law has not stated otherwise. Also, it is an isolated prostration, so two takbirs are not legislated at its commencement, like the prostration of forgetfulness. Moreover, it is a prostration of recitation, so it resembles how it is done if he prostrates it during prayer; their analogy is invalidated by the prostration of forgetfulness, and drawing an analogy between this and the prostration of forgetfulness is more appropriate than drawing an analogy between it and two rak'ahs, because it is closer to it and more similar to it. Additionally, the entering into the state of prayer (ihram) for two rak'ahs has many actions and pillars intervening between it and the prostration, so a single takbir does not suffice for the takbir of the prostration, whereas here nothing intervenes between them except the salutation, so a single takbir suffices, like the follower who has missed part of the prayer (masbuq) when he pronounces the takbir and prostrates, or bows.

Section: He shall raise his hands at (10) the takbir of [commencement if he is] (11) not in prayer.

= It was recorded by Abu Dawud in: The Chapter on the Man who hears the prostration verse while riding, from the Book of Prostration. Sunan Abi Dawud 1/236. (5) In (M): "for him for the takbir". (6) In (M): "It is authentically reported from the Prophet - peace and blessings of Allah be upon him - that he pronounced the takbir". (7) Omitted from: the original. (8) From here to the end of the section in (M): "He said: He pronounces one for the opening, and another for the prostration. Our evidence is the hadith of Ibn Umar, and its apparent meaning is that he pronounces one, and its analogy is to the prostration of forgetfulness after the salutation". (9) Which preceded shortly. (10) In (M): "with". (11) In (M): "the prostration if he prostrates".
