and therefore it takes precedence. As for the hadith of Amr ibn Abasah (17), the wordings of the narrators regarding it have differed, and it is in Sunan Ibn Majah: "until the dawn rises."

237 - Issue: He said: (And he shall not begin in these times a prayer to perform as a supererogatory act).

I do not know of any disagreement within the Madhhab that it is not permissible to begin a supererogatory prayer that does not have a specific cause. This is the position of al-Shafi'i and the scholars of the people of reason (Ahl al-Ra'y). Ibn al-Mundhir said: A group granted a concession for prayer after Asr. We have narrated this from Ali, al-Zubayr and his son, Tamim al-Dari (1), al-Nu'man ibn Bashir (2), Abu Ayyub al-Ansari, and Aisha. It was also practiced by al-Aswad ibn Yazid (3), Umar, Ibn Maymun, Masruq (4), Shurayh, Abdullah ibn Abi al-Hudhayl (5), Abu Burdah, Abd al-Rahman ibn al-Aswad (6), Ibn al-Baylamani (7), and al-Ahnaf ibn Qays (8). It was narrated from Ahmad that he said: We do not do it, but we do not criticize the one who does. This is based on the statement of Aisha, may Allah be pleased with her: The Messenger of Allah, may Allah bless him and grant him peace, never abandoned the two rak'ahs after Asr.

(17) Previously cited on page 514. (1) Tamim ibn Aws ibn Kharijah al-Dari, the Companion. He was a Christian who accepted Islam in the ninth year of the Hijra. He performed much nocturnal prayer (tahajjud), lived in Medina, and then moved to the Levant after the killing of Uthman. Usd al-Ghabah 1/256. (2) Al-Nu'man ibn Bashir ibn Tha'labah al-Ansari al-Khazraji. He was born eight years before the death of the Messenger of Allah, may Allah bless him and grant him peace. He was generous, a poet, and brave. He was killed in the year sixty-four. Usd al-Ghabah 5/326-329. (3) Abu Amr al-Aswad ibn Yazid ibn Qays al-Nakha'i. He heard from Mu'adh ibn Jabal in Yemen before migrating. He died in the year 74, and it is also said 75. al-Isabah 1/199.
