with {Sabbih isma rabbika al-a'la} and {Hal ataka hadithu al-ghashiyah}. Thus, when the two Eids and Jumu'ah coincide on one day, he should recite them as well in both prayers. Recorded by Muslim (5). Samurah ibn Jundab narrated that the Messenger of Allah (peace and blessings of Allah be upon him) used to recite in the Jumu'ah prayer {Sabbih isma rabbika al-a'la} and {Hal ataka hadithu al-ghashiyah} together (6). Recorded by Abu Dawud and al-Nasa'i (7). Malik said: As for that which the Hadith has brought, it is {Hal ataka hadithu al-ghashiyah} with Surah Al-Jumu'ah, while that upon which I found the people is {Sabbih isma rabbika al-a'la}. It was narrated from Abu Bakr Abd al-Aziz that he used to prefer reciting {Sabbih} in the second rak'ah (8), and perhaps he inclined toward what Malik narrated, that he found the people upon it. Following the Messenger of Allah (peace and blessings of Allah be upon him) is better. Whatever he recites is permissible and good, except that following the Messenger of Allah (peace and blessings of Allah be upon him) is superior, and because Surah Al-Jumu'ah is appropriate for Jumu'ah due to the mention of it therein, the command for it, and the urging toward it.

285 - Issue; He said: (And whoever catches a rak'ah of it with the Imam along with its two prostrations, he adds another to it, and it counts as his Jumu'ah).

Most of the scholars hold the view that whoever catches a rak'ah of Jumu'ah with the Imam, he has caught it; he adds another to it, and it suffices him. This is the opinion of Ibn Mas'ud, Ibn Umar, Anas, Sa'id ibn al-Musayyab, al-Hasan, Alqamah, al-Aswad, Urwah, al-Zuhri, al-Nakha'i, Malik, al-Thawri, al-Shafi'i, Ishaq, Abu Thawr, and the People of Opinion. Ata', Tawus, Mujahid, and Makhul said: Whoever does not catch the sermon, he prays four [rak'ahs]; because the sermon is a condition for Jumu'ah, so it cannot be Jumu'ah for one in whose case its condition is not found. Our evidence is what al-Zuhri narrated, from Abu Salamah, from Abu Hurayrah, from the Prophet (peace and blessings of Allah be upon him) who said: "Whoever catches a rak'ah of the Jumu'ah has caught the prayer." Recorded by al-Athram, and recorded by Ibn Majah (1), and its wording is: "So he should add another to it." And from Abu Hurayrah, from the Prophet (peace and blessings of Allah be upon him): "Whoever catches a rak'ah of the prayer has caught the prayer." Muttafaq alayh (2). And because it is the saying of those we named from the Companions, and there is no dissenter among them in their era.

286 - Issue; He said: (And whoever catches less than that with him, he builds upon it as Dhuhr, if he had entered with the intention of Dhuhr).

As for one who catches less than a rak'ah, he does not count as having caught Jumu'ah, and he prays Dhuhr as four. This is the opinion (1) of all those we mentioned in the issue before this. Al-Hakam, Hammad, and Abu Hanifah said: He is considered to have caught Jumu'ah regardless of the amount (2) he catches of the prayer with the Imam; because whoever is required to build upon the prayer of the Imam if he catches a rak'ah, he is also required to do so if he catches less.
