and Ishaq, except that they said: He performs seven takbirs in the first [rak'ah] excluding the opening takbir, based on the statement of 'Aisha: The Messenger of Allah, peace and blessings of Allah be upon him, used to perform twelve takbirs in the two Eids, excluding the opening takbir. [Narrated by al-Daraqutni] (1). It was also narrated from Ibn 'Abbas, Anas, al-Mughira ibn Shu'bah, Sa'id ibn al-Musayyab, and al-Nakha'i: He performs seven takbirs [in each]. Abu Hanifa and al-Thawri said: In the first and the second, he performs three takbirs each. They used the two hadiths of Abu Musa, which we have mentioned, as evidence. As for us, we have many hadiths, and those of 'Abd Allah ibn 'Amr and 'Aisha which we have previously mentioned. Ibn 'Abd al-Barr said: It has been narrated from the Prophet, peace and blessings of Allah be upon him, through many excellent chains of transmission that he performed seven takbirs in the first [rak'ah] of Eid and five in the second, from the hadith of 'Abd Allah ibn 'Amr, Ibn 'Umar, Jabir, 'Aisha, Abu Waqid, and 'Amr ibn 'Awf al-Muzani. There has not been narrated from him, through any strong or weak path, any contradiction to this, and it is the most appropriate [position] to be practiced. The known hadith of 'Aisha regarding him is that the Messenger of Allah, peace and blessings of Allah be upon him, performed seven and five takbirs in al-Fitr and al-Adha, excluding the two takbirs for bowing. Narrated by Abu Dawud and Ibn Majah (2). The hadith of Abu Musa is weak; it is narrated by Abu 'Aisha, a companion of Abu Hurayrah, and he is unknown.
306 - Issue; he said: (And he raises his hands with every takbir).
The collective meaning of this is that it is recommended that he raises his hands during the state of his takbir, just as he raises them with the opening takbir (takbirat al-ihram). This is the position of 'Ata', al-Awza'i, Abu Hanifa, and al-Shafi'i. Malik and al-Thawri said: He does not raise them for anything other than the opening takbir, because these are takbirs during the prayer, so they are similar to the takbirs of prostration. As for us, we rely on what has been narrated that the Prophet, peace and blessings of Allah be upon him, used to raise his hands with

وإسحاقُ، إلَّا أنَّهم قالوا: يُكَبِّرُ سَبْعًا في الأُولَى سِوَى تَكْبِيرَةِ الافْتِتاحِ؛ لِقَوْلِ عائشةَ: كان رَسولُ اللهِ -صلى اللَّه عليه وسلم- يُكَبِّرُ في العِيدَيْنِ اثْنَتَىْ عَشَرَةَ تَكْبِيرةً، سِوَى تَكْبِيرَةِ الافْتِتَاحِ. [رَوَاهُ الدَّارَقُطْنِىُّ] (١) وَرُوِىَ عن ابنِ عَبَّاسٍ، وأَنَسٍ، والمُغِيرَةِ بن شُعْبَةَ، وسَعِيدِ بن المُسَيَّبِ، والنَّخَعِىِّ: يُكَبِّرُ سَبْعًا سَبْعًا. وقال أبو حنيفةَ، والثَّوْرِىُّ: في الأُولَى والثَّانِيَةِ ثَلَاثًا ثَلَاثًا. واحْتَجُّوا بِحَدِيثَىْ أبي موسى اللَّذَيْنِ ذَكَرْنَاهما. ولَنا، أحَاديِثُ كَثِيرٍ، وعَبْدِ اللهِ بن عَمْرٍو، وعائشةَ، التي قَدَّمْنَاها. قال ابنُ عبد البَرِّ: قد رُوِىَ عن النَّبِيِّ -صلى اللَّه عليه وسلم- من طُرُقٍ كَثِيرَة حِسَان، أنَّه كَبَّرَ في العِيدِ سَبْعًا في الأُولَى، وخَمْسًا في الثانيةِ. من حَدِيثِ عبدِ اللهِ بن عَمْرٍو، وابنِ عمرَ، وجابِرٍ، وعائشةَ، وأبي وَاقِدٍ، وعَمْرِو بن عَوْفٍ المُزَنِىِّ، ولم يُرْوَ عنه من وَجْهٍ قَوِيٍّ ولا ضَعِيفٍ خِلافُ هذا، وهو أوْلَى ما عُمِلَ به. وحَدِيثُ عائشةَ المَعْرُوف عنها أنَّ رسولَ اللهِ -صلى اللَّه عليه وسلم- كَبَّرَ في الفِطْرِ والأضْحَى سَبْعًا وخَمْسًا سِوَى تَكْبِيرَتَىِ الرُّكُوعِ. رَوَاه أبو دَاوُدَ، وابنُ مَاجَه (٢). وحَدِيثُ أبي موسى ضَعِيفٌ، يَرْوِيه أبو عائشةَ جَلِيسٌ لأبي هُرَيْرَةَ، وهو غيرُ مَعْرُوفٍ.
٣٠٦ - مسألة؛ قال: (وَيَرْفَعُ يَدَيْهِ مَعَ كُلِّ تَكْبِيرَةٍ)
وجُمْلَتُه أنَّه يُسْتَحَبُّ أن يَرْفَعَ يَدَيْهِ في حال تَكْبِيرِه حَسَبَ رَفْعِهما مع تَكْبِيرَةِ الإِحْرَامِ. وبه قال عَطَاءٌ، والأوْزَاعِىُّ، وأبو حنيفةَ، والشَّافِعِىُّ. وقال مالِكٌ، والثَّوْرِىُّ: لا يَرْفَعُهما فيما عدا تَكْبِيرَةَ الإِحْرامِ؛ لأنَّها تَكْبِيرَاتٌ في أثْناء الصلاةِ، فأشْبَهَتْ تَكْبِيرات السُّجُودِ. ولَنا، ما رُوِىَ أنَّ النَّبِيَّ -صلى اللَّه عليه وسلم- كان يَرْفَعُ يَدَيْه مع
