the Musnad (3). They disagreed regarding the recommended haste. The Qadi said: The recommended haste is a speed that does not deviate from a normal walking pace. This is the opinion of al-Shafi'i. The Ahl al-Ra'y (the jurists of opinion) said: One should jog and trot; this is based on what Abu Dawud narrated from 'Uyayna ibn 'Abd al-Rahman, from his father, who said: We were at the funeral procession of 'Uthman ibn Abi al-'As, and we were walking at a light pace. Abu Bakra caught up with us (4), raised his whip, and said: 'I have seen us with the Prophet (may Allah bless him and grant him peace) trotting with a trot' (5). Our evidence is what Abu Sa'id narrated from the Prophet (may Allah bless him and grant him peace): that a funeral procession passed by him being shaken violently, and he (peace be upon him) said: "Practice moderation in your funeral processions." From the Musnad (6). From Ibn Mas'ud, he said: We asked our Prophet (may Allah bless him and grant him peace) about walking with the funeral procession. He said: "Anything less than jogging (7)." Narrated by Abu Dawud and al-Tirmidhi (8), who said: It is narrated by Abu Majid, who is unknown. The statement of the Prophet (may Allah bless him and grant him peace): "Speed up (9) with it, and do not tread in the manner of the Jews," indicates that what is meant is a speed that distances one from the likeness of the Jews' way of walking with their funeral processions, and because excessive haste shakes the deceased, harms those carrying it and those following it, and one cannot be certain of the safety of the deceased. Ibn 'Abbas said regarding the funeral procession of Maymuna: "Do not shake it, be gentle, for she is your mother."

"المُسْنَدِ" (٣). واخْتَلَفُوا في الإِسْراعِ المُسْتَحَبِّ، فقال القاضي: المُسْتَحَبُّ إسْرَاعٌ لا يَخْرُجُ عن المَشْىِ المُعْتادِ. وهو قولُ الشَّافِعِيِّ. وقال أصْحابُ الرَّأْىِ: يَخُبُّ، ويَرْمُلُ؛ لما رَوَى أبو دَاوُدَ، عن عُيَيْنَةَ بن عبدِ الرحمنِ، عن أبِيهِ. قال: كُنَّا في جِنَازَةِ عُثمانَ بن أبي الْعَاصِ، فَكُنَّا نَمْشِى مَشْيًا خَفِيفًا، فَلَحِقَنَا أبو بَكْرَة (٤)؛ فَرَفَعَ سَوْطَهُ، فقال: لقد رَأيْتُنَا مع النَّبِيِّ -صلى اللَّه عليه وسلم- نَرْمُلُ رَمَلًا (٥). ولَنا، ما رَوَى أبو سَعِيد، عن النَّبِيِّ -صلى اللَّه عليه وسلم-: أنَّه مَرَّ عليه بِجِنَازَةٍ تُمْخَضُ مَخْضًا، فقال عليه السَّلَامُ: "عَلَيْكُمْ بالْقَصْدِ في جَنَائِزِكُمْ". من "المُسْنَدِ" (٦). وعن ابنِ مسعودٍ قال: سَألْنَا نَبِيَّنَا -صلى اللَّه عليه وسلم- عن المَشْىِ بالجِنَازَةِ. فقال: "ما دُونَ الخَبَبِ (٧) " رَوَاه أبو دَاوُدَ، والتِّرْمِذِيُّ (٨). وقال: يَرْوِيه أبو ماجِدٍ، وهو مَجْهُولٌ. وقولُ النَّبِيِّ -صلى اللَّه عليه وسلم-: "انْبَسِطُوا (٩) بِهَا، وَلَا تَدِبُّوا دَبِيبَ اليَهُودِ". يَدُلُّ على أنَّ المُرَادَ إسْرَاعٌ يَخْرُجُ به عن شِبْهِ مَشْىِ اليَهُودِ بِجَنَائزِهم، ولأنَّ الإِسْرافَ في الإِسْراعِ يَمْخُضُهَا، ويُؤْذِى حَامِلِيها ومُتَّبِعِيهَا، ولا يُؤْمَنُ على المَيِّتِ. وقد قال ابنُ عَبَّاسٍ، في جِنَازَةِ مَيْمُونَةَ: لا تُزَلْزِلُوا، وَارْفُقُوا، فإنَّها أُمُّكُمْ.
فصل: واتِّبَاعُ الجَنَائِزِ سُنَّةٌ. قال الْبَرَاءُ: أمَرَنَا رسولُ اللهِ -صلى اللَّه عليه وسلم- بِاتِّبَاعِ
