by her punishment, nor in the cemetery of the disbelievers; because her child is a Muslim and would be harmed by their punishment. She is to be buried separately. Moreover, a similar opinion is narrated from Wathila ibn al-Asqa', while it is narrated from Umar that she is to be buried in the cemeteries of the Muslims (4). Ibn al-Mundhir said: This is not established. Our companions said: Her back should be placed toward the qibla on her left side, so that the face of the fetus is toward the qibla on its right side, because the face of the fetus is toward her back.
394 - Issue: He said: (And he removes his sandals when he enters the graveyards.)
This is recommended, based on what Bashir ibn al-Khasasiyah narrated, who said: While I was walking with the Messenger of Allah (may Allah bless him and grant him peace), a man was walking among the graves wearing sandals. He said: "O wearer of the two sabtiyyah (sandals made of tanned leather), take off your two sandals." The man looked, and when he recognized the Messenger of Allah (may Allah bless him and grant him peace), he took them off and threw them away. Narrated by Abu Dawud (2). Ahmad said: The chain of narration for the hadith of Bashir ibn al-Khasasiyah is good, and I follow it, unless there is a flaw. Most scholars do not see anything wrong with it. Jarir ibn Hazim said: I saw al-Hasan and Ibn Sirin walking among the graves in their sandals. Some of them used as evidence the saying of the Prophet (may Allah bless him and grant him peace): "When the servant is placed in his grave and his companions turn away from him, he hears the clatter of their sandals." Narrated by al-Bukhari (3). Abu al-Khattab said: It is likely that the Prophet (may Allah bless him and grant him peace)

بِعَذَابِها، ولا في مَقْبَرَةِ الكُفَّارِ؛ لأنَّ وَلَدَها مُسْلِمٌ فيَتَأَذَّى بِعَذَابِهم، وتُدْفَنُ مُنْفَرِدَةً. مع أنَّه رُوِىَ عن وَاثِلَةَ بن الأسْقَعِ مثلُ هذا القَوْلِ، وَرُوِىَ عن عمرَ أنَّها تُدْفَنُ في مَقابِرِ المسلِمين (٤). قال ابنُ المُنْذِرِ: ولا يَثْبُتُ ذلك. قال أصحابُنا: ويُجْعَلُ ظَهْرُها إلى القِبْلَةِ على جَانِبِها الأيْسَر، ليكونَ وَجْهُ الجَنِينِ إلى القِبْلَةِ على جَانِبِه الأيْمَنِ، لأنَّ وَجْهَ الجَنِينِ إلى ظَهْرِها.
٣٩٤ - مسألة؛ قال: (ويَخْلَعُ النِّعَالَ إذَا دَخَلَ الْمَقَابِرَ)
هذا مُسْتَحَبٌّ؛ لما رَوَى بَشِيرُ بنُ الْخَصَاصِيَةِ، قال: بَيْنَا أنا أُماشِى رسولَ اللَّه -صلى اللَّه عليه وسلم- إذا رَجُلٌ يَمْشِى في القُبُورِ، عليه نَعْلانِ، فقال: "يَا صَاحِبَ السِّبْتِيَّتَيْنِ (١)، أَلْقِ سِبْتِيَّتَيْكَ". فَنَظَرَ الرَّجُلُ، فلمَّا عَرَف رسولَ اللهِ -صلى اللَّه عليه وسلم- خَلَعَهما، فَرَمَى بهما. رَوَاهُ أبو دَاوُدَ (٢). وقال أحمدُ: إسنادُ حَدِيثِ بَشِيرِ بنِ الْخَصَاصِيَة جَيِّدٌ، أَذْهَبُ إليه، إلَّا مِن عِلَّةٍ. وأكْثَرُ أهْلِ العِلْمِ لا يَرَوْنَ بذلك بَأْسًا. قال جَرِيرُ بنُ حَازِمٍ: رأيْتُ الحسنَ، وابنَ سِيرِينَ، يَمْشِيَانِ بين القُبُورِ في نِعَالِهما. ومِنهم مَن احْتَجَّ بِقَوْلِ النَّبِيِّ -صلى اللَّه عليه وسلم-: "إنَّ العَبْدَ إذا وُضِعَ فِي قَبْرِهِ، وتَوَلَّى عَنْهُ أَصْحَابُه، إنَّهُ يَسْمَعُ قَرْعَ نِعَالِهِمْ". رَوَاهُ البُخَارِىُّ (٣). وقال أبو الخَطَّابِ: يُشْبِهُ أن يكونَ النَّبِىُّ -صلى اللَّه عليه وسلم-
