with his chain of narration from ‘Ata’ ibn Yasar, from the Prophet (peace be upon him) that he said: "Charity is not permissible for a wealthy person, except for five: a warrior in the path of Allah, or one employed to collect it, or a debtor, or a man who purchased it with his wealth, or a man who had a poor neighbor and he gave charity to the poor person, then the poor person gifted it to the wealthy man." It was also narrated by [12] ‘Ata’ from Abu Sa‘id, from the Prophet (peace be upon him).
Section: If several reasons requiring the taking of zakat gather in one person, it is permissible for him to be given for them. Thus, a poor worker (employed to collect zakat) may take his commission, and if it does not suffice him, he may take what completes his sufficiency. If he is a warrior, he may take what suffices him for his battle, and if he is a debtor, he may take what will pay off his debt. This is because the ruling for each of these reasons is established individually, so the presence of another does not prevent the establishment of its ruling, just as its existence did not prevent it. It has been narrated from Ahmad that he said: If one possesses two hundred [dirhams] and owes the like of it, he is not given from the zakat, because the [threshold of] wealth [al-ghina] (13) is fifty dirhams. This indicates that it is considered, in giving to a debtor, that he be poor. So if he is given for the sake of the debt, it is obligatory to spend it on paying the debt, and if he is given as a poor person, it is permissible for him to pay his debt with it.
428 - Issue; He said: (And not for the Banu Hashim).
We know of no disagreement that for the Banu Hashim, the obligatory charity is not permissible for them. The Prophet (peace be upon him) said: "Charity is not appropriate for the family of Muhammad; it is merely the impurities of people." Narrated by Muslim (1). And from Abu Hurayrah, he said: Al-Hasan took a date from the dates of charity, and the Prophet (peace be upon him) said: "Kakh, kakh!" [an expression of disapproval] so that he would throw it away, and he said: "Do you not realize that we do not eat charity?" Agreed upon (2).
