that 'Umar, may Allah be pleased with him, commanded him [to pay] the tithe on honey. As for milk, the Zakah is mandatory on its foundation, which is the pasturing livestock, unlike honey. Abu Hanifah's statement is predicated on the principle that the tithe ('ushr) and the land tax (kharaj) do not combine, and we shall mention that, if Allah the Almighty wills.

Section: The threshold (nisab) for honey is ten faraq. This is the opinion of al-Zuhri. Abu Yusuf and Muhammad said: Five wasqs, due to the statement of the Prophet (peace and blessings of Allah be upon him): "There is no charity on less than five wasqs." Abu Hanifah said: It is mandatory on both small and large amounts, based on his principle regarding grains and fruits. The rationale for the first [opinion] is what was narrated from 'Umar, may Allah be pleased with him, that people asked him, saying: "The Messenger of Allah (peace and blessings of Allah be upon him) allotted us a valley in Yemen containing beehives, and we find people stealing from them." 'Umar, may Allah be pleased with him, said: "If you pay its charity—one faraq from every ten faraqs—we will protect it for you." Narrated by al-Jawzajani. This is a measurement from 'Umar, may Allah be pleased with him, so it is required to defer to it. Once this is established, the faraq is sixteen Iraqi ratls, so its threshold is one hundred and sixty ratls. Ahmad said, in a narration by Abu Dawud: Al-Zuhri said, in ten faraqs there is one faraq, and the faraq is sixteen ratls. Ibn Hamid said: The farq is sixty ratls, so the threshold would be six hundred ratls, for it is narrated that al-Khalil ibn Ahmad said: The farq (with the ra' sakin)—is a large vessel among the measuring vessels of the people of Iraq. It has also been said: It is one hundred and twenty ratls, and it is possible that its threshold is one thousand ratls, based on the hadith of 'Amr ibn Shu'ayb, that it was taken during the time of the Messenger of Allah (peace and blessings of Allah be upon him) from skins of honey—from every ten skins, one skin of their average quality. The skin (qirba), when used absolutely, is one hundred ratls, given that
