year (hawl), so no threshold (nisab) is considered for it, just like rikaz. Our position is the generality of his (peace be upon him) statement: "There is no sadaqah on less than five awaq," and his saying: "There is nothing on one hundred and ninety," and his saying (peace be upon him): "You owe nothing on gold until it reaches twenty mithqals." We have already clarified that this is not rikaz, and that it differs from rikaz in that rikaz is the property of an infidel taken in the lands of Islam, making it akin to war booty. However, this [mine output] is made mandatory out of sympathy and in gratitude for the blessing of wealth, so a threshold (nisab) is considered for it like other zakats. The reason a hawl (year) is not considered for it is that it is obtained all at once, making it similar to crops and fruits.
Once this is established, it is considered that the threshold must be extracted all at once or in batches, provided that the work between them is not interrupted by negligence. If one extracts less than the threshold, then abandons the work neglectfully, and then extracts less than the threshold, there is no zakat on either, even if they reach a threshold in total. If one of them reaches a threshold while the other does not, one pays zakat on the threshold [that reached it], and there is no zakat on the other. Anything exceeding the threshold is calculated accordingly. As for stopping work at night, for rest, or due to an excuse such as illness, repair of equipment, or the escape of [slaves or the like], it does not interrupt the state of the work, and what is extracted in the two stages is added together to complete the threshold. The same applies if one is occupied with work and soil is extracted between the two [sessions of mining], as there is nothing in that.
If the mine contains different categories, such as a mine containing gold and silver, the Qadi stated: that one is not to be added to the other to complete the threshold, and that the threshold is considered for each type separately; because they are [different] categories, so the threshold of one cannot be completed by the other, as is the case with non-mineral assets.
