501 - Issue: He said: (Likewise, the woman whose menstruation ceases during the night, she is considered fasting if she forms the intention for the fast before the break of dawn, and she performs ghusl when she reaches the morning).
In summary, the ruling regarding a woman whose menstruation ceases during the night is exactly the same as the ruling for one in a state of janaba. It is a condition that her menstruation ceases before the break of dawn, because if any part of it remains during the day, it invalidates the fast. It is also required that she form the intention for the fast from the night after it has ceased, because there is no fast for one who does not establish the intention for fasting from the night. Al-Awza'i, al-Hasan ibn Hayy, Abd al-Malik ibn al-Majishun, and al-'Anbari said: She must make up the fast, regardless of whether she was negligent in performing the ghusl or not, because the state of menstruation prevents fasting, unlike janaba. Our evidence is that it is a state of impurity that requires ghusl, so delaying the ghusl until morning does not prevent the validity of the fast, just like janaba. What they mentioned is not correct; for she who has become pure from menstruation is no longer menstruating, but rather there remains upon her a state of impurity requiring ghusl, so she is like one in a state of janaba. Indeed, sexual intercourse requiring ghusl, if it occurred during the fast, would invalidate it, just like menstruation, and the continued obligation of ghusl from it is like the continued obligation of ghusl from menstruation. Some scholars have cited as evidence the saying of Allah the Almighty: {So now, have relations with them and seek that which Allah has decreed for you. And eat and drink until the white thread of dawn becomes distinct to you from the black thread of the night}. So when He permitted relations until the break of dawn, it was known that the ghusl only takes place after it.
502 - Issue: He said: (The pregnant woman if she fears for her fetus, and the nursing mother for her child, they break their fast, make it up, and feed a poor person for every day).
