al-Waqidi, and he is weak. Regarding 'Amr ibn al-'As, he said: "These are the days that the Messenger of Allah (peace and blessings of Allah be upon him) commanded us to break our fast and forbade us to fast." Malik said: "These are the days of Tashriq." [Recorded by Abu Dawud] (3). It is not permissible to fast them as a voluntary fast, according to the opinion of most scholars. It is narrated from Ibn al-Zubayr that he used to fast them, and something similar is narrated from Ibn 'Umar and al-Aswad ibn Yazid. From Abu Talhah, it is narrated that he would not break his fast except on the two days of the Eids. The obvious implication is that these individuals did not receive the prohibition of the Messenger of Allah (peace and blessings of Allah be upon him) regarding fasting them; had it reached them, they would not have deviated from it to follow someone else. Abu Murrah, the freed slave of Umm Hani, narrated that he entered with 'Abd Allah ibn 'Amr upon his father, 'Amr ibn al-'As, who served them food and said: "Eat." He replied: "I am fasting." 'Amr said: "Eat, for these are the days that the Messenger of Allah (peace and blessings of Allah be upon him) commanded us to break our fast and forbade us to fast" (4). The obvious implication is that 'Abd Allah ibn 'Amr broke his fast once the prohibition of the Messenger of Allah (peace and blessings of Allah be upon him) reached him. As for fasting them for an obligatory fast, there are two narrations. One: It is not permissible, because fasting them is forbidden, so they resemble the two days of the Eid. The second: It is valid to fast them for an obligatory fast, due to what was narrated from Ibn 'Amr and 'A'ishah, who said: "No concession was granted to fast during the days of Tashriq except for those who could not find the sacrificial animal (hady)." That is, the Mutamatti' (one performing Hajj Tamattu') if he cannot find the sacrificial animal. This is a Sahih hadith, recorded by al-Bukhari (5). Every obligatory fast is measured by analogy to this.
