considers Umrah obligatory, and says: "O people of Makkah, there is no Umrah upon you; your Umrah is your tawaf (circumambulation) around the House." 'Ata' and Tawus held this view. 'Ata' said: "There is no one among the creation of Allah who is not required to perform Hajj and Umrah as two obligations that are unavoidable for those who find a way to them, except the people of Makkah; for upon them is Hajj, but not Umrah, because of their tawaf around the House." The reasoning for this is that the pillar of Umrah and the majority of it is the tawaf around the House, and since they perform it, it suffices them. The Qadi interpreted the statement of Ahmad to mean that there is no Umrah upon them along with the Hajj, because they often perform it at a time other than the time of Hajj. The matter is as we have stated.

Section: The Umrah of the mutamatti' (the one performing Tamattu' Hajj), the Umrah of the qarin (the one performing Qiran Hajj), and the Umrah from the nearest hill (adna al-hill) suffice for the obligatory Umrah, and we know of no disagreement regarding the sufficiency of the Umrah of Tamattu'. Likewise said Ibn Umar, 'Ata', Tawus, and Mujahid, and we know of no disagreement from others. It has been narrated from Ahmad that the Umrah of the qarin does not suffice, and this is the choice of Abu Bakr. It is also narrated from Ahmad that the Umrah from the nearest hill does not suffice for the obligatory Umrah; he said: "It is only from four miles." He argued that the Umrah of the qarin does not suffice by noting that 'A'isha, when she began her menses, was sent by the Prophet (peace be upon him) to perform Umrah from al-Tan'im (27), and if her Umrah within her Qiran had sufficed her, he would not have sent her to perform it afterward. As for our evidence, it is the statement of al-Dabbi ibn Ma'bad: "I found Hajj and Umrah written upon me, so I entered into ihram for both." Umar said: "You have been guided to the sunnah of your Prophet (28)." This indicates that he entered into ihram for both believing in the performance of what Allah had written upon him regarding them and being discharged from the obligation of them, so Umar approved of him and said: "You have been guided to the sunnah of your Prophet." Regarding the hadith of 'A'isha when she performed Qiran for Hajj and Umrah, the Prophet (peace be upon him) said to her when she exited from them: "You have exited from your Hajj and your Umrah" (29). The Prophet (peace be upon him) only sent her to perform Umrah from al-Tan'im intentionally
