Malik, al-Shafi'i, and the Ashab al-Ra'y. 'Ata' said: It is valid, and he should recite the takbir for every pebble. Our evidence is that the Prophet (peace and blessings of Allah be upon him) threw seven times and said: "Take your rites from me" (30). Some of our companions said: It is recommended to raise his hands while throwing until the whiteness of his armpits can be seen.
647 - Issue: He said: (And he ceases the talbiyah upon starting the throwing.)
Among those who said that one should recite the talbiyah until throwing the Jamrah are Ibn Mas'ud, Ibn 'Abbas, and Maymunah. This is also the opinion of 'Ata', Tawus, Sa'id ibn Jubayr, al-Nakha'i, al-Thawri, al-Shafi'i, and the Ashab al-Ra'y. It is reported from Sa'd ibn Abi Waqqas and 'A'ishah that he ceases the talbiyah when he sets out for the station (at 'Arafat). From 'Ali and Umm Salamah, it is reported that they used to recite the talbiyah until the sun passed its zenith on (1) the day of 'Arafah, which is close to the opinion of Sa'd and 'A'ishah. Al-Hasan used to say: One recites the talbiyah until he prays the morning prayer on the day of 'Arafah. Malik said: He ceases the talbiyah when he sets out to the mosque. Our evidence is that al-Fadl ibn 'Abbas reported that the Prophet (peace and blessings of Allah be upon him) did not cease reciting the talbiyah until he threw the Jamrat al-'Aqabah (2). He was his companion on the mount that day, and he was more knowledgeable of his state than others. The statement and action of the Prophet (peace and blessings of Allah be upon him) take precedence over anyone who opposes him. It is recommended to cease the talbiyah upon the first pebble; [due to the report, and in some of its wordings: Until he threw the Jamrat al-'Aqabah, he ceased at the first pebble] (3). This was narrated by Hanbal in "Al-Manasik." This is a clarification that must be adopted. In the narration of those who reported that the Prophet (peace and blessings of Allah be upon him) would recite the takbir with every pebble (4), there is proof that he was not reciting the talbiyah, and because he achieves partial deconsecration (tahallul) by the throwing, so when he commences

مَالِكٍ، والشَّافِعِىِّ، ؤأصْحَابِ الرَّأْىِ. وقال عَطاءٌ: يُجْزِئُه، ويُكَبِّرُ لِكُلِّ حَصَاةٍ. ولَنا، أنَّ النَّبِيَّ -صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ- رَمَىَ سَبْعَ رَمَيَاتٍ، وقال: "خُذُوا عَنِّى مَنَاسِكَكُمْ" (٣٠). قال بعضُ أصْحابِنا: ويُسْتَحَبُّ أن يَرْفَعَ يَدَيْهِ في الرَّمْىِ حتى يُرَى بَيَاضُ إبطِهِ.
٦٤٧ - مسألة؛ قال: (ويَقْطَعُ التَّلْبِيَةَ عِنْدَ ابْتِدَاءِ الرَّمْىِ)
وممَّن قال: يُلَبِّى حتى يَرْمِىَ الجَمْرَةَ. ابنُ مسعودٍ، وابنُ عَبَّاسٍ، ومَيْمُونَةُ. وبه قال عَطاءٌ، وطاوُسٌ، وسَعِيدُ بن جُبَيْرٍ، والنَّخَعِىُّ، والثَّوْرِىُّ، والشَّافِعِىُّ، وأصْحابُ الرَّأْىِ. ورُوِىَ عن سَعْدِ بن أبى وَقَّاصٍ، وعائشةَ: يَقْطَعُ التَّلْبِيَةَ إذا رَاحَ إلى المَوْقِفِ. وعن علىٍّ، وأُمِّ سَلَمَةَ، أنَّهُما كانا يُلَبِّيانِ حتى تَزُولَ الشمسُ مِن (١) يومِ عَرَفَةَ. وهذا قَرِيبٌ من قَوْلِ سَعْدٍ، وعائشةَ. وكان الحسنُ يقولُ: يُلَبِّى حتى يُصَلِّىَ الغدَاةَ يومَ عَرَفَةَ. وقال مَالِكٌ: يَقْطَعُ التَّلْبِيَةَ إذا رَاحَ إلى المسجدِ. ولَنا، أنَّ الفَضْلَ بنَ عَبّاسٍ رَوَى أنَّ النَّبِىَّ -صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ- لم يَزَلْ يُلَبِّى حتى رَمَى جَمْرَةَ العَقَبَةِ (٢). وكان رَدِيفَه يَوْمَئِذٍ، وهو أعْلَمُ بِحَالِه من غيرِه، وقَوْلُ النَّبِيِّ -صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ- وفِعْلُهُ مُقَدَّمٌ على كلِّ مَن خَالَفَهُ. واسْتُحِبَّ قَطْعُ التَّلْبِيَةِ عندَ أَوَّلِ حَصَاةٍ؛ [للْخَبَرِ، وفى بعضِ ألْفاظِه: حتى رَمَى جَمْرَةَ العَقَبةِ قَطَعَ عندَ أوَّلِ حَصَاةٍ] (٣). رَوَاهُ حَنْبَلٌ، في "المَنَاسِكِ". وهذا بَيَانٌ يَتَعَيَّنُ الأَخْذُ به. وفي رِوَايَةِ مَن رَوَى أنَّ النَّبِيَّ -صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ- كان يُكَبِّرُ مع كلِّ حَصَاةٍ (٤) دَلِيلٌ على أنَّه لم يَكُنْ يُلَبِّى، ولأنَّه يَتَحَلَّلُ بِالرَّمْىِ، فإذا شَرَعَ
