depart with the people. As for that which they drew an analogy to, it does not resemble the case we are discussing, for he has indeed hastened in two days.

Section: If he delays the stoning of a day until after it, or delays all the stoning until the end of the days of Tashriq, he has abandoned the Sunnah but incurs no liability, except that he must intend the stoning of the first day, then the second, then the third. This is the opinion of al-Shafi'i and Abu Thawr. Abu Hanifa said: If he leaves a pebble, two, or three until the next day, he stones them, and for each (11) pebble he owes half a sa', and if he leaves four, he stones them, and he owes a sacrificial animal (dam). Our evidence is that the days of Tashriq are a time for stoning; therefore, if he delays it from the beginning of its time to the end of it, nothing is required of him, just as if he delayed the standing at Arafat until the end of its (12) time. Furthermore, it is a time during which stoning (13) is permissible, so it is permissible for others, just like the first day. The Qadi said: His stoning on the second day is not considered a makeup (qada') because it is one unified time. Even if it is called (14) a makeup, the intended meaning is the performance of the act, as in His statement: {Then let them end their untidiness} (15), and their saying: "I have performed (qadaytu) the debt." The ruling regarding the stoning of Jamrat al-Aqaba, if one delays it, is like the ruling regarding the stoning (16) of the days of Tashriq, in that if it is not performed on the Day of Sacrifice, it is performed on the following day. We only stated that order is required by his intention (17) because these are acts of worship in which order is mandatory while performing them within their [designated] days; thus, their collective order is obligatory, similar to two combined prayers or missed prayers.
