Section: Among the conditions for the obligation of the blood sacrifice upon him is that he not be of the residents of the Sacred Mosque, according to the opinion of the majority of scholars. Ibn al-Majishun said: He is liable for a blood sacrifice, because Allah the Almighty only exempted the blood sacrifice [from the mutamatti'], and this [qarin] is not a mutamatti'. This is not correct, for we have already mentioned that he is a mutamatti'; even if he were not considered a mutamatti', he is still a branch of one, and the obligation of blood upon the qarin is based on the meaning of the text regarding the mutamatti', so it is not permissible for the branch to contradict its origin.

668 - Issue: He said: "And whoever performs Umrah during the months of Hajj, then performs Tawaf and Sa'i, and exits ihram, then enters into ihram for Hajj in the same year, and has not traveled from Mecca to a distance where prayer is shortened, he is a mutamatti' and is liable for a blood sacrifice."

The discussion on this issue is divided into several parts. First, the obligation of the blood sacrifice upon the mutamatti' in general. The scholars are in consensus regarding it. Ibn al-Mundhir said: The scholars are in consensus that whoever enters into ihram for Umrah during the months of Hajj from among the people of distant lands at the miqat, arrives at Mecca and finishes it, resides there, and performs Hajj in the same year, he is a mutamatti' and is liable for the sacrificial offering if he finds it; otherwise, he is liable for fasting. Allah the Almighty has stipulated this in His saying: {Then whoever performs Umrah during the Hajj period...} [to the end of the verse]. Ibn Umar said: "The people performed Tamattu' with the Messenger of Allah (may Allah bless him and grant him peace) by combining Umrah with Hajj." When the Messenger of Allah (may Allah bless him and grant him peace) arrived, he said to the people: "Whoever among you has not brought a sacrificial animal, let him perform Tawaf of the House, and Sa'i between al-Safa and al-Marwa, and shorten his hair, then enter into ihram for Hajj and offer a sacrifice. Whoever does not find a sacrificial animal, let him fast three days during the Hajj and seven when he returns to his family." Agreed upon. Jabir said: "We used to perform Tamattu' with the Messenger of Allah (may Allah bless him and grant him peace) by combining Umrah with Hajj, and we would slaughter a cow on behalf of seven people, participating in it."
