from his Umrah, remaining in his state of Ihram, and he was a Qarin (performing Hajj Qiran). Al-Shafi'i said: It is permissible to slaughter it after entering Ihram for Hajj, with one view, and regarding the time before that, after completing his Umrah, there are two possibilities. The rationale for its permissibility is that it is a blood sacrifice connected to the Ihram, for which fasting can be substituted, so it is permissible before the Day of Sacrifice, like the blood sacrifice for the use of perfume or wearing clothes. Furthermore, because it is permissible to replace it before the Day of Sacrifice, it is permissible to discharge it before it, like other expiations.

669 - Issue: He said: "If he does not find [it], then he must fast three days, the last of which is the Day of Arafah, and seven when he returns."

We are not aware of any disagreement among the scholars that the Mutamatti' (pilgrim performing Tamattu'), if he does not find the Hady, transfers to fasting for three days during the Hajj and seven when he returns, [this is due to the saying of Allah the Almighty: "Whoever performs the Umrah to the Hajj, then what is easy of the Hady. But if he cannot find [it], then a fast of three days during Hajj and seven when you have returned]. Those are ten complete [days]." Ability is considered according to his location; whenever he lacks it in his location, it is permissible for him to transfer to fasting, even if he were capable of it in his own country. This is because its obligation is timed, and whatever has a timed obligation, capability is considered at the time it is due in his location, like water for purification; if he lacks it in his place, he transfers to [using] earth.

Section: Each of the three days and the seven days has two times: a time of permissibility and a time of desirability. As for the time for the three, the preferred time for them is that he should fast them between his entering Ihram for Hajj and the Day of Arafah, and the last of the three should be the Day of Arafah. Tawus said: He fasts three days,

عن عمْرَته، وأقَامَ على إحْرَامِه، وكان قَارِنًا. وقال الشَّافِعِىُّ: يجوزُ نَحْرُه بعدَ الإِحْرامِ بِالحَجِّ. قَوْلًا وَاحِدًا، وفيما قَبْلَ ذلك، بعدَ حِلِّهِ من العُمْرَةِ، احْتَمالانِ؛ وَوَجْهُ جَوَازِه أنَّه دَمٌ يَتَعَلَّقُ بِالإِحْرامِ، ويَنُوبُ عنه الصِّيامُ، فجازَ قبلَ يومِ النَّحْرِ، كَدَمِ الطِّيبِ واللِّباسِ، ولأنَّه يجوزُ إبْدَالُه قبلَ يومِ النَّحْرِ، فجازَ أدَاؤُه قبلَه، كسائِرِ الفِدْيَاتِ.

٦٦٩ - مسألة؛ قال: (فَإنْ لَمْ يَجِدْ، فَصِيَامُ ثَلَاثَةِ أَيَّامٍ، يَكُونُ آخِرُهَا يَوْمَ عَرَفَةَ، وسَبْعَةٍ إذَا رَجَعَ)

لا نَعْلَمُ بين أهْلِ العِلْمِ خِلافًا، فى أنَّ المُتَمَتِّعَ إذا لم يَجِد الهَدْىَ، يَنْتَقِلُ إلى صِيامِ ثلاثةِ أيَّامٍ فى الحَجِّ وسَبْعَةٍ إذا رَجَعَ [وذلك لِقولِ اللهِ تعالى: {فَمَنْ تَمَتَّعَ بِالْعُمْرَةِ إِلَى الْحَجِّ فَمَا اسْتَيْسَرَ مِنَ الْهَدْيِ فَمَنْ لَمْ يَجِدْ فَصِيَامُ ثَلَاثَةِ أَيَّامٍ فِي الْحَجِّ وَسَبْعَةٍ إِذَا رَجَعْتُمْ] (١) تِلْكَ عَشَرَةٌ كَامِلَةٌ} (٢). وتُعْتَبَرُ القُدْرَةُ فى مَوْضِعِه، فمتى عَدِمَه فى مَوْضِعِه جازَ له الانْتِقَالُ إلى الصِّيامِ، وإن كان قَادِرًا عليه فى بَلَدِهِ؛ لأنَّ وُجُوبَهُ مُوَقَّتٌ، وما كان وُجُوبُه مُوَقَّتًا اعْتُبِرَتِ القُدْرَةُ عليه فى مَوْضِعِه، كالماءِ فى الطَّهارَةِ، إذا عَدِمَه فى مَكَانِه انْتَقَلَ إلى التُّرَابِ.

فصل: ولِكُلِّ واحِدٍ من صَوْمِ الثَّلَاثَةِ والسَّبْعَةِ وَقْتَانِ (٣)؛ وَقْتُ جَوازٍ، وَوَقْتُ اسْتِحْبابٍ. فأمَّا وَقْتُ (٣) الثَّلَاثَةِ، فَوَقْتُ الاخْتِيارِ لها أن يَصُومَهَا ما بين إحْرَامِه بِالحَجِّ وَيوْمِ عَرَفَةَ، ويكونُ آخِرُ الثَّلاثةِ يَوْمَ عَرَفَةَ. قال طَاوُسٌ: يَصُومُ ثلاثةَ أيَّامٍ،
